Adopt Resolution #19-029 Approving an Extension for Building Removal and Code Enforcement Actions at 9539 Highway 10 NW

Purpose/Background:

The purpose of this case is to review a request from Ron West (the "property owner") at 9539 Highway 10 NW (the "Subject Property") for an extension until May 1, 2019 to remove an unpermitted structure from the property that was previously constructed by a former tennat which did not recieve a building permit.

Notification:

No notification required.

Observations/Alternatives:

The previous tennat at 9539 Highway 10 constructed a detached accessory building on the property without the issuance of a building permit. Additionally, the structure did not meet minimum design standards per Zoning Code. That tenant has since left the property and Staff has been working with the property owner on the removal of the structure. The property maintains lawful nonconforming rights related to automotive sales and paving. The construction of the new building also constituted an expansion of that nonconforming use which was not permitted by the City. Removal of the structure will clear both violations. The property owner is working with local contractors to obtain bids and schedule a time for building removal as weather conditions allows.

Funding Source:

Staff handles code enforcement as part of their normal duties.

Recommendation:

Staff recommends approval of Resolution #19-029, which will extend the time for building removal of an unpermitted structure at 9539 Highway 10.

Action:

Motion to adopt Resolution #19-029 extending the time for building removal of an unpermitted structure at 9539 Highway 10.
