Adopt Resolution #19-034 Clarifying Definition of Complaint Based Code Enforcement

Purpose/Background:

The purpose of this case is to clarify the City Council's definition of Complaint Based Code Enforcement.

Notification:

Notification is not required.

Observations/Alternatives:

At the January 8, 2019 meeting, the City Council approved policy changes to the City's Code Enforcement Program through Resolution #19-023. During that case, discussion ensued regarding the definition of complaint-based code enforcement in the context of potential proactive enforcement along key corridors.

Staff believes this policy question can be resolved by simply clarifying the definition of Complaint-Based. In review of the January 8 discussion, Staff believes that the City Council is comfortable with the complaint-based nature of the program to include formal complaints by residents submitted to the City -OR- violations observed by City Staff in the course of their normal duties. Stated another way, complaint-based enforcement is not a proactive sweep by City officials or dispatching a City official with the specific task to find code violations.

Funding Source:

This case is being prepared as part of normal Staff duties.

Recommendation:

Staff recommends that the City Council adopts Resolution #19-034.

Action:

Motion to adopt Resolution #19-034 clarifying definition of Complaint Based Code Enforcement.
