Title:
Adopt Resolution 19-087 for Final Plat, Development Agreement and Introduce Ordinance 19-08 to Vacate Easements for Harvest Estates 2nd Addition.
Purpose/Background:
The purpose of this case is to approve the final plat and development agreement for Harvest Estates 2nd Addition, a fifteen (15) lot residential subdivision. The Applicant has proposed to subdivide the approximately six and a half (6.5) acre parcel into fifteen (15) single family lots serviced by City utilities. The site is generally located at the site of the old municipal center, east of Nowthen Boulevard and south of Alpine Drive. The lot is legally described as Lot 25, Block 1 Harvest Estates (the "Subject Property").
The Project required a zoning text amendment to allow for 65 foot-wide lots via a new zoning district (Detached Villas) and the rezoning of the Subject Property. The City Council approved these two items at their March 2019 meeting.

Notification:
Staff attempted to notify all Property Owners within 700 feet of the Subject Property of the preliminary plat review.

Observations/Alternatives:
Summary: The proposed preliminary plat shows 15 detached villas. The proposal now meets all the requirements of the new, R-1 Detached Villa residential district regulations. The plan was updated to show additional trees along the southern property line, per the recommendation of the Planning Commission and City Council during the preliminary plat stage. Underlying drainage and utility easements need to be vacated, which will be replaced with new easements in similar locations on the new plat.
Roads/Connection: The preliminary plat shows the access off Nowthen Blvd remaining. Staff worked with the Development Review Committee and will require that the developer reconstruct and maintain this access to a level acceptable by the City throughout construction and until the completion of the project.

Alternatives:
- Adopt Resolution #19-087 Approving Final Plat and Development Agreement - This would allow the project to move into the construction phase, after the site is purchased from the City. The City rezoned the Subject Property and approved the preliminary plat. The Developer has updated the plan sheets to reflect the required changes; Staff supports this alternative.
- Deny Resolution #19-087 - This would stop the project and the potential sale of the land. The preliminary plat was already approved, and as the final plat meets what was proposed at the preliminary plat stage, Staff does not support this alternative.
- Table Resolution #19-087 - This would push the discussion back two weeks until the next City Council meeting, allowing Staff time to work with the Developer to answer specific questions related to the plan sheets or Development Agreement; Staff could support this alternative if the City Council needs additional information on a specific topic in order to approve.
Funding Source:
All costs associated with processing the Application are the responsibility of the Applicant. The Planning Commission has recommended approval of this project.
Recommendation:
Staff and Planning Commission recommend approval of the Final Plat and Development Agreement. Staff and the Planning Commission recommend vacating underlying drainage and utility easements, which will be replaced with new easements.
