Title:
Closed Session Pursuant to Section 13D.05 and the Attorney-Client Privilege
Purpose/Background:
This item is to review an item of pending litigation. In order to consider this litigation, the City Council must meet with its attorney in a confidential setting to obtain advice regarding pending litigation. It would be detrimental to the interest of the City to hold a public discussion with its attorney regarding its legal positions and strategy. The matter to be discussed relates to a former employee. The specific subjects to be discussed, pursuant to Minn. Stat. § 13D.01, subd. 3, are the City’s legal positions, defenses, and strategies with respect to the pending litigation. Pursuant to Minnesota Statutes, section 13D.05, subd. 3(b) and the attorney-client privilege, the Council will be asked to entertain a motion that the meeting be closed for the purposes stated.
Recommendation:
The Attorney for the City will summarize the closed meeting and advise the City Council regarding the appropriate action to be taken.
