Title

Adopt Resolution #19-146 Acknowledging Update on Code Enforcement Case at 14760 Bowers Drive NW and Granting Extension to Required Dwelling Repairs (Case of Sandra Dickson)

Purpose/Background:

The purpose of this case is to receive a brief update on the open code enforcement case for numerous violations at 14760 Bowers Drive NW. Staff had an open code enforcement case last year that was halted over the winter due to extreme temperatures, Staff has since restarted work on the case as the extension ended May 31, 2019. This is the most recent case on this property, with 41 violations since 2008.

  • February 5, 2019 - Formal Extension (Fifth Letter)
  • April 25, 2019 - Courtesy Reminder Letter (Indicating Nearing End of Extension)
  • June 5, 2019 - Formal Letter Requesting Inspection
  • June 13, 2019 - Inspection of Property
  • June 14, 2019 - Follow Up Letter/Notice of Abatement (Attached)

Staff has seen progress onsite with the nuisance items and outside storage; however, there are several items that still need to be addressed. For these items, Staff has scheduled an abatement (removal) for the week of July 1, 2019.

The Dwelling/Structure itself is in violation of the City's Property Maintenance Code. For these items, Staff needs information from the homeowner on their timeline for an MHFA loan - which would be used for siding, window repair, roof repair, etc.

Staff would like to note the gazebo in the front yard that has been wrapped with plastic and enclosed. This was a portion of a previous code enforcement case and Staff would like to see it removed - it is not an allowable structure type, nor is it safe. The plastic was wet when Staff inspected and the homeowner mentioned there was a mattress stored inside for her niece when she visits. Staff would like to see this removed as soon as possible, though this is not able to be abated, so Staff would need to bring this to a court setting to have addressed.

Staff has tentatively scheduled an abatement for the week of July 1, 2019 for the items that can be abated, and is waiting to hear back from the resident on the potential MHFA loan to repair the home.
