ACTION REQUESTED:
Ordinance 26-11: authorize to advertise to hold a public hearing on proposed Ordinance 26-11: An Ordinance amending Chapter 21 of the Roswell City Code related to Solid Waste Rate Indexing. (Arnold/Chaparro)
BACKGROUND:
Initiated by: Abraham Chaparro
Presently, Roswell Code of Ordinances (RCO) 21-20(f) provides that City Council shall review and adjust solid waste rates at the beginning of each fiscal year. Proposed Ordinance 26-XX would strike subsection (f) of RCO 21-20 and add a new section (21-21) that would automatically index solid waste rates to inflation by establishing an annual indexing process for solid waste rates when the City Council does not otherwise implement a rate increase or decrease following its annual review. The proposed indexing would be based on the Consumer Price Index for Garbage and Trash Collection, as published by the U.S. Bureau of Labor Statistics, beginning January 1, 2027.

FINANCIAL CONSIDERATION:
Solid waste rates may be adjusted annually based on the applicable Consumer Price Index. Rates indexed to inflation would help ensure that the associated enterprise fund remains solvent as costs to provide the service increase with inflation.
LEGAL REVIEW:
The City Attorney has reviewed the proposed ordinance.
BOARD AND COMMITTEE ACTION:
The Legal Committee voted (5-0) to refer to City Council at their meeting on September 24, 2026.
STAFF RECOMMENDATION:
Proceed as presented.
