SUBJECT: Amendments to Town Code Chapter 12, Floodplain Management - Consideration & Possible Action (2nd Reading, Public Hearing) [John Litteer, PE, Town Engineer]

 
VISION 2024 FOCUS AREA:

SUMMARY/BACKGROUND:

Like other counties, Yavapai County has a Flood Control District under ARS Title 48, Chapter 21, Article 1 that regulates development in order to avoid damage from storm water. There is an option under ARS 48-3610 for cities and towns within the District to assume the District's powers and duties within their jurisdictions (including adoption of floodplain management regulations). The Town has exercised this option since shortly after its incorporation.

Because federal funding under the National Flood Insurance Program is at stake, the Arizona Department of Water Resources (ADWR) is involved in ensuring that local floodplain management regulations are up-to-date in relation to federal and state requirements. ADWR has adopted a 3 to 5 year Community Assist Visit cycle to review local regulations. Prescott Valley had an ADWR inspection in May 2026 that resulted in proposed updates to the Town's version of the model ADWR floodplain regulations (Town Code Chapter 12). Since then, Town staff (including the Legal Department) has worked with ADWR staff to prepare a final set of Amendments for Town Council consideration.

At a regular meeting on September 24, 2026, after holding a public hearing, the Town Council voted to read Ordinance No. 2026-984 by title only on two separate occasions, then place the same on final passage. 

Now, in consideration of these amendments, the Town Council will hold a second public hearing (public notice having been provided). The Town Clerk will then read Ordinance No. 2026-984 by title only for the second reading, after which the Mayor will ask if the Ordinance should pass. If the vote is in favor of passage, Ordinance No. 2026-984 would be effective 30 days thereafter.

RECOMMENDED MOTION:

[the Mayor instructs the Town Clerk to read Ordinance No. 2026-984 adopting by reference that certain public record entitled “Chapter 12 Floodplain Management” by title only for the 2nd Reading, then asks “Shall the Ordinance Pass?”] VOTE.

STAFF RECOMMENDATION:

Town staff recommends reading and ultimately adopting Ordinance No. 2026-984 approving proposed Amendments to Chapter 12 Floodplain Management.

FISCAL ANALYSIS:

There is no anticipated direct fiscal impact due to the requested action.
