ZMC26-002:
Upon the application of Pinnacle Consulting (Logan Williams, owner), this is a request for a Zoning Map Change (ZMC26-002) from CN-PD (Commercial: Neighborhood Sales and Services, Planned Area Development) to RL-10 PD (Residential; Single Family Limited, Planned Area Development), with a condition of a Special Use Permit, on approximately 0.30 acres to accommodate development of Cell Tower. [APN #103-61-001]
NEIGHBORHOOD FEEDBACK:
A virtual neighborhood meeting for both this Zoning Map Change (and the related Minor General Plan Amendment) was held on May 14, 2026. In accordance with the Town Code, 102 notifications were sent out on April 27, 2026 for this meeting (with the meeting ID and contact information for the applicant). Two people responded to the mailing with concern about the location and information was provided about why the location was chosen over others. In the meeting, the applicant (along with a Radio Frequency consultant) were available. No one attended the meeting. Following the meeting, no additional comments or outreach were received by the applicant.
GENERAL PLAN:
The Town of Prescott Valley General Plan 2035 designates the project area as Community Commercial. It must be changed to Low Density Residential in conjunction with the related rezoning to RL-10 PD (Residential; Single Family Limited, Planned Area Development) with a special use permit.
Areas north and west of the site are designated as Low Density Residential, Areas south of the site are designated Community Commercial. Areas to the East are designated as Public/Quasi.
ZONING SUMMARY:
The current zoning designation is CN-PD (Commercial; Neighborhood Sales and Services, Planned Area Development).
North and west of the site are zoned RL-10 PD (Residential; Single-Family Limited, Planned Area Development). South of the site is zoned CN-PD (Commercial; Neighborhood Sales and Services, Planned Area Development). To the east is PL (Public Lands).
The request is to change the zoning designation to RL-10 PD (Residential; Single-Family Limited, Planned Area Development).
The related Zoning Map Change is required because the parcel lines are being moved south to include this 0.30 acres in APN #103-31-001. Town Code 13-03-030(A).requires that the zone boundaries follow lot lines and parcels must have only one zoning designation. Adjustment of the lot line is proposed as a condition of this rezoning, and the applicant will submit the lot line adjustment upon approval.
The proposal is for a 100’ cell tower that will be disguised as a pine tree (monopine). The monopine branches will extend above the cell tower (to a maximum height of 105’). The height will allow for multiple carriers to attach to the pole in the future (instead of having to have multiple cell towers in the area).
The screened ground equipment enclosure for the cell tower will be separate from the cell tower itself, with the total leased land being approximately 1,408 square feet.
Towers, antennas, and wireless telecommunications facilities must be set back from any lot line a distance equal to at least 100% of the height of the structure unless the zoning district where the facility is located requires a greater setback. The nearest setback to a property line will be the new property line on the south, and will be the minimum of 100’ (height of the actual tower).
The nearest home is to the north approximately 312’ away from the tower on Range View Drive.
Landscaping, lighting, and screening shall be installed pursuant to the requirements of Town Code Articles 13-11 and 13-12 respectively. The landscape design will include a plant palette with a variety of tree types, shrubs, and ground cover that adhere to the Prescott Valley and/or Prescott Active Management Area (“AMA”) low water use plant material list (in character with the surrounding development). Native vegetation should be used whenever possible.
Section 13-13-110(G) allows a special use permit in the rezone as long as it is expressly authorized as a condition of rezoning and included in the zoning entitlement plan.
Federal Communications Commission (FCC) regulation Section 332(c)(7) applies to local zoning of such cell towers.
PLANNING AND ZONING COMMISSION:
A Public Hearing on ZMC26-002 was held by the Planning and Zoning Commission (P&Z) on September 14, 2026. Several pertinent questions and concerns were raised by the P&Z Commission (including questions about the height of the tower, landscape design, the gap in cell service coverage, and residents' request for better service in the area). One resident spoke at the Public Hearing to voice concern about needing improved cell service to her medical providers. After discussion, the P&Z Commission voted 5-0 (One Commissioner was absent and one vacancy) to recommend approval of the application to the Town Council, with the enumerated conditions.
PROPOSED CONDITIONS OF APPROVAL:
In accordance with Town Code §13-13-110(G), the use of a cell tower (allowed by special use permit) is expressly authorized at this location as a condition of this re-zoning (being included in the approved site plan/zoning entitlements plan).
The maximum height of the actual cell tower (5 feet less than the monopine structure), shall not exceed 100 feet.
The facility shall comply with all applicable FAA, FCC, building code, fire code, and other federal, state, and local requirements.
The facility shall provide for collocation consistent with the approved application and Town requirements.
Any maintenance or replacement of equipment (including disguise...monopine) must mitigate any pollution, degradation, fading, or habitat impacts.
Any change or modification to the tower’s disguise—specifically the approved monopine—must be submitted in writing to the Director of Development Services for approval.
The applicant must submit an appropriate landscape scheme that would blend into the environment with building permits.
The lot line adjustment shown in the site plan must be recorded prior to issuance of building permits.
FIRE SUMMARY:
CAFMA has reviewed this project and had no comments on the proposed cell tower.
[Note: In accordance with ARS §12-1134(I), the applicant has been asked to sign the standard Proposition 207 waiver agreement.]
THIS ACTION:
Having held its own public hearing on ZMC26-002, it is proposed the Town Council consider whether to approve this Zoning Map Change by ultimately adopting Ordinance No. 2026-987. If so, the Council would vote to read the Ordinance by title only on two separate occasions, then place the same on final passage. Ordinance No. 2026-987 would then be read by the Town Clerk by title only for the first reading. At a subsequent Council meeting (currently anticipated to be October 22, 2026) the Clerk would read the Ordinance by title only for the second reading, and the Council would then vote on whether to adopt the same. If adopted, Ordinance No. 2026-987 would not be effective for 30 days.
RECOMMENDED MOTION:
Motion to read Ordinance No.2026-987 adopting ZMC26-002 by title only on two separate occasions, then place the same on final passage, OR Motion not to read Ordinance No. 2026-987. VOTE.
