SUMMARY/BACKGROUND:
ARS §4-201(B) requires a person who files for a liquor license inside a municipality to file the application with the Director of the Arizona Department of Liquor License and Control (“ADLL&C”). The Director then forwards the application to the municipal Clerk who posts a copy for twenty (20) days in a conspicuous place on the front of the premises where the business will be conducted. The notice says anyone who is a bona fide resident residing or owning or leasing property within a one-mile radius of the premises to be licensed (who is in favor of or opposed to issuing the license) shall file written arguments in favor of or opposed to the license with the Clerk no later than twenty (20) days after the posting date. After the time for filing arguments has passed, a hearing on the application is held before the local governing body (and that body either recommends approval or denial of the application to the ADLL&C).
Ryan Witner Anderson, Agent, filed a location / owner transfer application for a Series 9 (Liquor Store) Liquor License on behalf of Roberts Marketplace located at 6640 N. Viewpoint Drive. The Series 9 Liquor Store license is a transferable Arizona off-sale license that authorizes retail sale of beer, wine, and distilled spirits in their original, unopened containers for off-premises consumption. Commonly used by liquor and package stores, these licenses can be purchased from existing holders on the open market or obtained through the Arizona liquor license lottery when new or reverted licenses become available. The Affidavit of Posting for this application is attached. No arguments in favor of or opposed to issuance of the license were submitted
It is now proposed that the Town Council hold a public hearing on this application to consider any additional public comments. After any public comments, it is requested that the Council vote to recommend either approval or denial of the application to the ADLL&C.

RECOMMENDED MOTION:
Motion to recommend approval of the Series 9 Liquor Store License on behalf of Roberts Marketplace located at 6640 N. Viewpoint Drive, Prescott Valley, AZ 86315 to the Arizona Department of Liquor License and Control. VOTE.
STAFF RECOMMENDATION:
Town staff recommends that the Town Council recommend approval of the application for a Series 9 Liquor License for Roberts Marketplace located at 6640 N. Viewpoint Drive, Prescott Valley, AZ 86315.
FISCAL ANALYSIS:
Historically, the Town has anticipated collection of Transaction Privilege Taxes from the sale of products related to such licenses.
