Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 2nd day of December 2025. Present also were Ms. Carmen L. Saldaña, Recording Secretary representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

County Treasurer, Raul Reyes presented the Bills and Disbursements for the period of 11/24/2025 - 12/04/2025 that included the Recap of Checks, EFT's, and the payments released by general order.

County Treasurer, Raul Reyes presented the Liability Disbursements of the County payroll for the pay period of 11/14/2025 - 11/27/2025, as well as the Casa Blanca Golf Course payroll from prior date of 11/28/2025 and the estimated payroll for the future pay periods of 12/12/2025, 12/26/2025 and01/09/2026. Casa Blanca revenue for period of 11/10/2025 to 11/23/2025 was presented as well.

Risk Management Director, Samantha Sanchez advised the court they will be providing a Distracted Driving Course on the dates 12/09/2025 & 12/10/2025 where they will be raffling gift cards for those who attend. Employees will also gain a Wellness Point if they choose to attend.
Commissioner, Pct. 2 Rosaura “Wawi” Tijerina suggested the course become mandatory for all those who operate a county vehicle and are under employment of Commissioners Court.
 

Motion by Commissioner, Pct. 2 Rosaura “Wawi” Tijerina, seconded by Commissioner, Pct. 1 Jesse Gonzalez to approve Distracted Driving Course become mandatory under the discretion of the court, as well as extend courtesy to elected officials

Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Discussion and possible action to approve a 1-month agreement (effective October 1, 2025 to October 31, 2025) between Webb County for the benefit of the Webb County Court-at-Law II Juvenile Drug Treatment Court Program and Attorney Estella Rodriguez in the amount not to exceed Six Hundred Dollars ($600.00). The services will allow the Juvenile Drug Treatment Court Program participants to have access to legal guidance and legal representation while in the program; as listed and approved on the grant application through Department of Justice O-OJJDP-2023-171678 and authorize the Webb County Judge to sign all relevant documents and any other matters incident thereto. All required documents were sent for review to the Economic Development Department and the acceptance of the grant award is compliant with the Webb County Single Point of Contact (SPOC) procedures.  [Account #2355-2070-001-432001]

Issue: Webb County Court-at-Law II established a Juvenile Drug Treatment Court to service area juvenile drug offenders to community resources, including legal and mental health services. Ms. Rodriguez has been the attorney since the courts inception, but has accepted a position within Webb County that would not allow her to continue being the contracted attorney for the court. 

Solution: Effectively service area juveniles through legal guidance and representation.

Result: Obtaining legal services from an attorney is a key component of grant requirements.

Discussion and possible action to ratify a one (1) year service agreement between Webb County for the benefit of the Webb County TEND Court Program and Happy and Healthy Counseling, PLLC., counseling services for the performance period of (October 1, 2025, through September 30, 2026), at a cost not to exceed Two Thousand Five Hundred Dollars ($2,500), and authorizing the County Judge to sign and execute all relevant documents; and any other matters incident thereto. Issue: Child Protective Services (CPS) transfers foster youths from one foster placement to another placement, including outside of Laredo/Webb County, which often results in gaps with counseling services. 
  
Solution: Webb County’s approval of the Agreement allows for foster children in the program to secure much needed counseling sessions and eliminate any potential gaps in counseling services.
 
Result: The program will ensure that foster-placed children are provided much-needed counseling services and avoid potential gaps with their counseling services when said youth are moved from one foster placement to another.

Issue: Various departments depleted funds within departmental budget line items; nonetheless, multiple invoices were received for goods or services after the fiscal year-end, which required an apply date of FY-2025.

Solution: In order to process year-end transactions and pay invoices, funding was identified as approved by Commissioners Court on August 25, 2025, to allow Auditor's Office and Business Office to enter and post budget amendments.

Result: Funds were transferred to cover pending invoices and properly classify transactions in FY-2025.

Discussion and possible action to remit $1,048,252.65, the positive arbitrage/yield, to the Department of Treasury on January 5, 2026 filing due date.  Hilltop Securities Assets Management LLC, acting as the agent of Webb County, determines the County’s requirements for investment earnings rebate “Arbitrage Amount” from the proceeds in connection with the sale of certain bonds, notes, certificates, or other tax-exempt obligations, pursuant to the provisions of 1993 Treasury Regulations Section 1.148-5(c); and any other matters incident thereto.

Issue: The rebate computation requires to remit positive arbitrage/yield as of the fifth anniversary date.

Solution: Remit the positive arbitrage/yield as of the fifth anniversary date to Department of Treasury pursuant to the Internal Revenue Code.

Result: County will be in compliance with Internal Revenue Code.

Issue: The proposed Capital Project budgets were based on year-end estimates as of August 2025. Capital Project budgets require the correct available balances for fiscal year 2026.

Solution: Capital Project budget amendments to have the appropriate available funding.

Result: With these budget amendments, the Capital Project funds will have the correct available balances for October 1, 2025.

Solution: At its meeting of October 14, 2025, the Commissioners Court awarded RFP 2025-010 “Alarm Monitoring, Inspections and Maintenance Services-3 Year Contract” to Patriot Fire and Security.

Issue: Webb County CAA El Aguila Rural Public Transit is an agency whose services are primarily funded through the utilization of state and federal grants. 

Solution: The approval by the Webb County Commissioner’s Court to amend the Federal 5311 grant monies will allow El Aguila Rural Transit to receive the funds.

Result: Approval of the contract amendment will ensure continuation of transportation services to serve the residents living in the rural areas of Webb County.

Discussion and possible action to authorize the Auditors to create an expenditure and revenue account for the Webb County Community Action Agency to receive funds from sponsors for the purpose of holding a Golf Tournament on May 23, 2026, to raise funds for the purchase of food for the clients of the Community Action Agency to be distributed through the Meals on Wheels & Elderly Nutrition Program, and the Pantry of Hope. All proceeds from this fundraiser will go to these Meals on Wheels programs. The fundraising event will require the following requests to succeed. No impact to the general fund.

List of Requests:
•   Authorize the planning and hosting of a Meals-on-Wheels Benefit Golf Tournament as a fundraising event.
•   Authorize the use of the Lake Casa Blanca Golf Course.
•   Authorize an expenditure/revenue account for the Meals-on-Wheels Benefit Golf Tournament.
•   Establish a dedicated budget line for food expenses, to be funded solely by donations generated through this event.

Issue: The Webb County Community Action Agency’s Meals on Wheels program provides daily nutritious meals and vital wellness checks to vulnerable seniors in our community. As the demand for services continues to grow, additional funding is critical to sustain and expand our ability to serve those in need.

Solution: The agency is proposing to hold a Benefit Golf Tournament to take place at the Lake Casa Blanca Golf Course, to raise funds exclusively for the Meals on Wheels Program. This event will be made possible through the support of community donors and sponsors, who will help pay for the tournament expenses.

Results: The proceeds from the players' entry fees will go directly toward the food account, which will be directly used for purchasing nutritious foods for the Meals-on-Wheels program clients.

Discussion and possible action to approve a professional services agreement (September 30, 2025, through September 29, 2026) between Webb County for the Veterans Treatment Program and Recovery Monitoring Solutions for services associated with the monitoring devices at costs that are outlined and defined per service as set forth in the agreement. Discussion and possible action to adopt the Pre-Approved Government Plan 457(b) “Deferred Compensation” amendment effective January 01, 2026, and exercise the county’s right to continue the 3rd party administration agreement between Webb County and Nationwide Financial Service, Inc. for the purpose of administering the 457(b) plan; and authorizing the Webb County Judge to sign all relevant documents and any other matters incident thereto.

Issue: Effective January 01, 2026, under a provision of the Secure 2.0 Act (Section 603) mandates that certain employees make their catch-up contributions to a Roth (after-tax) account instead of a traditional pre-tax account. The current 457(b) plan does not include a Roth feature, making the existing plan document noncompliant with this federal requirement.

Solution: Adopt the Pre-Approved Government Plan 457(b) Deferred Compensation Amendment, which includes the Roth deferral provision, and authorize continuation of the Nationwide Financial Services agreement, allowing participants to make both pre-tax and Roth contributions, including catch-up contributions, depending on their eligibility.

Result: Amending the plan ensures compliance with federal guidelines and enables eligible employees to continue to make catch-up contributions beginning January 1, 2026.
