Discuss, consider and take appropriate action on approving change order to Southwest Regional Park Splash Pad repair agreement originally approved on 03.22.2022 under agenda item #35 in the amount of $15,652.50, adding an amount of $23,200.00, exempting this purchase from the competitive bid/proposal requirements pursuant to the discretionary exemption as set forth under Texas Local Government Code § 262.024 (2) [an item necessary to preserve and protect the public health or safety or the residents of the county] and § 262.024 (3) [an item necessary because of unforeseen damage to public property].

A contract was approved for Perez Construction LLC to perform repairs at the Southwest Regional Park Splash Pad. During the repairs the crew discovered that the stonework and boulders for the waterfall area were unstable and visibly showing cracks and movement. The unsafe conditions are such that urgent/immediate repairs are needed to stabilize the movement of the stones and boulders under and along the waterfall feature. As Perez Construction LLC is already on site and aware of the problems and mitigation steps are necessary a proposal was requested for the additional work needed.
