Discuss, consider, and take appropriate action regarding Change Order No. 2 in the amount of $414,400.00 for Project 22IFB57 CR 401 Reconstruction (James Construction) P: 390c Funding Source: Road Bond.

This Change Order introduces an incentive-based compensation plan to reduce the project Contract Time by 70 days, from 505 Calendar days to 435 Calendar Days. This acceleration in the Contract Time is necessary, in order to meet the County’s project delivery commitment of July 31, 2023 specified in the project development agreement. The Project Construction Manual (PCM) will be updated to reflect all required Contract document changes. An incentive Special Provision (000-WC05) and a revised definition of Substantial Completion will also be added to the contract documents via this Change Order.

This Change Order also modifies the Contract to add the State of Texas Child Support Business Ownership Form to the Contract Manual.

This Change Order results in an increase of $414,400.00 to the Contract amount, for an adjusted Contract total of $13,100,916.46. The original Contract amount was $12,673,200.94. As a result of this and all Change Orders to-date, $427,715.52 has been added to the Contract, resulting in a 3.37% net increase to the overall Contract cost. As a result of this Change Order, seventy (70) days will be subtracted from the Contract Time.
