Discuss, consider and take appropriate action to terminate agreement for Construction Services Contract #22IFB113 between Williamson County and Blacksmith Ventures, LLC dated effective July 13, 2022, for Brushy Creek and Fern Bluff Intersections Milling and Inlay, and authorizing the execution of the termination document.

This contract was awarded July 13, 2022, and work began September 7, 2022.  The contractor’s work performed has met specifications with exception to the daily production rate.  The daily production rate has been slow which has caused inconvenience to the traveling public.  The work remaining in the contract requires a higher production rate than the contractor can accomplish.  Additionally, the work remaining will require the temporary closure and detour of a heavily traveled intersection with a short duration to complete.  Based on the contractor’s performance and the increased daily production rate needed for the remainder of the contract, we are recommending termination of this contract.  Notice of contract termination letter is attached. At this time there are no additional funds to be paid.
