Pursuant to Sec. 571.018 (h), Texas Health and Safety Code (attached for your review), “the state or county may not pay any costs for a patient committed to a private mental hospital unless: (1) a public facility is not available; and (2) the commissioners court of the county authorizes the payment, if appropriate.” Williamson County has received a filings fees invoice from Brazos County, a county which has authorized the payment of filing fees for private mental hospitals. This matter concerns whether Williamson County should now pay for filing fees incurred by Brazos County for a Williamson County resident.
