Discuss, consider, and take appropriate action on authorizing the Williamson County Judge to execute a Settlement Participation and Release Form regarding settlement offers from Associated Pharmacies, Inc. (and American Associated Pharmacies), JM Smith Corporation, Morris and Dickson Co., L.L.C., Louisiana Wholesale Drug Company, Inc., North Carolina Mutual Wholesale Drug Company, Inc., and United Natural Foods, Inc. (and SuperValu) [“Remnant Defendants”] in the matter of Texas opioid multi-district litigation for; Williamson County in the matter of County of Williamson v. Purdue Pharma, Inc., et al., MDL PRETRIAL CAUSE NO. 2018-63587, in the 152d District Court of Harris County, Texas; and direct the Williamson County Auditor to deposit the settlement funds in Williamson County's Opioid Fund.

Public Background

Williamson County must execute Settlement Participation and Release Form in order to participate in a nationwide settlement with six opioid supply chain defendants (Associated Pharmacies, Inc. (and American Associated Pharmacies), JM Smith Corporation, Morris and Dickson Co., L.L.C., Louisiana Wholesale Drug Company, Inc., North Carolina Mutual Wholesale Drug Company, Inc., and United Natural Foods, Inc. (and SuperValu) [collectively referred to in the litigation as the “Remnant Defendants”]).  Of the Remnant Defendants, only Morris and Dickson were defendants in the Texas opioid litigation. The nationwide settlement is in the amount of $97,625,000 and Williamson County’s allocation would be $46,200.00.  The settlement amount would be paid directly to the County and there would not be any portion withheld for the Opioid Abatement Fund.  The settlement to Williamson County would be paid in one lump sum before the end of this year.
