Discuss, consider and take appropriate action on acknowledging a potential conflict and request to consent to Nossaman LLP’s agreement to represent RR Campus, LP as to environmental issues relating to a real property development located in Williamson County and Travis County. 

Because Nossaman represents both Williamson County and the Williamson County Conservation Foundation (WCCF) the firm has, under the applicable Rules of Professional Conduct, requested consent to representation of another entity and requested appropriate waivers from both WCCF and the County. Conflict under this waiver is potential but not likely. The private entity has entered into a Participation Agreement with the WCCF under the County's Habitat Conservation Plan. The facts are straight forward and staff does not believe a conflict is at issue. The Participation Agreement, should conflict occur, has provisions that WCCF and the County may terminate the Participation and that the Participant's sole recourse is toreceive return of the associated participation fee upon surrender of the participation.
