Discuss, consider and take appropriate action on approving the continued imposition of a bingo prize fee as authorized under Chapter 2001 of the Texas Occupations Code (the Bingo Enabling Act) and authorize the execution of an attestation form notifying the Texas Lottery Commission of Williamson County's vote to continue imposing the bingo prize fee and confirming that Williamson County was entitled to receive a share of the bingo prize fee as of January 1, 2019.
Background
The bingo prize fee is five percent of a cash bingo prize of more than $5. Fifty percent of the prize fee goes to the Texas Lottery Commission. The other fifty percent of the prize fee goes:
(A) solely to a county that votes to continue to receive the other fifty percent of the prize fee provided the location at which the bingo game is conducted is not within the boundaries of a municipality that voted to also impose the prize fee by November 1, 2019; OR
(B) solely to a municipality that votes to continue to receive the other fifty percent of the prize fee provided the county in which the bingo game is conducted did not vote to impose the fee by November 1, 2019; OR
(C) in equal shares, to a county and a municipality, provided each voted to continue to impose the fee before November 1, 2019; OR
(D) if neither the county or municipality in which the bingo game is conducted voted before November 1, 2019, to continue to impose the prize fee, the other fifty percent of the prize fee will be deposited in the general charitable fund of the organization or on a pro rata basis to the general funds of the organizations comprising the unit, as applicable, to be used for the charitable purposes of the organization or organizations.
If Williamson County does not vote to continue to receive a share of the bingo prize fee by November 1, 2019, the County’s share of the bingo prize fee will either go to a municipality that voted to continue to receive the bingo prize fee by November 1, 2019 OR, if a municipality also did not vote to continue to receive a share of the prize fee, the portion that would have gone to a county and/or city will be deposited in the general charitable fund of the organization or on a pro rata basis to the general funds of the organizations comprising the unit, as applicable, to be used for the charitable purposes of the organization or organizations.
The County currently receives a payment annually that is less than $50,000 per year.
