Discuss, consider and take appropriate action on a resolution authorizing the Presiding Officer of the Williamson County Commissioners Court to execute a Deed without Warranty from the City of Granger, Texas, in trust for the use and benefit of the Granger Independent School District, and Williamson County, Texas to Mister Exterior of the City of Austin pertaining to All Lots 11, 12,13,14, 15,16, and 17 and the South 40-feet of Lots 18, 19, and 20, Block 27, Original Townsite of the City of Granger, described in Document #2010070250 of the Official Public Records, Williamson County, Texas (R012620).

Background

In 2009, Williamson County filed a lawsuit to collect delinquent property taxes on behalf of itself, Granger Independent School District, and the City of Granger, Texas vs. James Mays et al. On June 8th, 2010, a judgment was signed ordering foreclosure of the tax lien on property account R012620, located on Willis Street in Granger. Pursuant to the Property Tax Code, in October of 2010, the property was offered for sale at a public tax foreclosure sale. The property did not receive a bid and was taken into trust by the County for the use and benefit of all the taxing jurisdictions. This property has been held in trust with an exempt status since October 2010 and has therefore been completely exempt from taxation since that date. Michael Perkins, on behalf of Mister Exterior LLC, has tendered a purchase offer of $4,000, which is an amount greater than the market value specified in the judgment of foreclosure. By accepting this offer, the County would place the property back on the tax rolls and produce tax revenue for all applicable taxing units.

For the reasons stated herein, it is counsel’s recommendation to approve the offer by Mister Exterior LLC to purchase property account R012620 out of trust.
