Discuss, consider and take appropriate action on the purchase of a Glock Model 23 Handgun by Detective Steve Hall following his retirement from the Williamson County Sheriff’s Office for the fair market value of $200, in accordance with Texas Government Code, Chapter 614, Subchapter D.

Background

Steve Hall has retired from a 23 year law enforcement career with the Williamson County Sheriff’s Office. Detective Hall was issued a Glock 23 handgun by the Williamson County Sheriff’s Office. This particular handgun was assigned to Detective Steve Hall in 2004 and has remained with him throughout his law enforcement career with Williamson County. Detective Hall expressed an interest in purchasing the weapon from the County upon his retirement. The purchase of firearm by an honorably retired peace officer is allowed by State statute with the permission of the governmental entity as per Texas Government Code, Chapter 614, Subchapter D. 

Sec. 614.051.  PURCHASE OF FIREARM BY HONORABLY RETIRED PEACE OFFICER. 
(a)  An individual may purchase a firearm from a governmental entity if:
(1)  the individual was a peace officer commissioned by the entity;
(2)  the individual was honorably retired from the individual's commission by the entity;
(3)  the firearm had been previously issued to the individual by the entity; and
(4)  the firearm is not a prohibited weapon under Section 46.05, Penal Code.
(b)  An individual may purchase only one firearm from a governmental entity under this section.
 

Sec. 614.053.  PURCHASE PRICE OF FIREARM
A governmental entity shall establish the amount, which may not exceed fair market value, for which a firearm may be purchased under this subchapter.
 
According to research on the serial number, the handgun was manufactured in 2002 with a retail price of $500. The weapon is in good, working condition, has no modifications, and is not a prohibited weapon as defined by section 46.05 of the Texas Penal Code. The weapon has what would be considered well maintained for a weapon which is over 19 years old, none of which affect the functionality of the weapon. For this type and model of handgun, the current value listed by auction houses or retail sale sites runs from $100.00 to $250.00. The value is mainly based on condition and the fact that it is not a rare weapon. It has been determined that fair market value for the handgun is $200.00 Due to the age of the weapon, less than modern features and the limited availability of parts, any repairs in the future would be cost prohibitive. For example, a replacement barrel for this weapon retails for $150.00.  If approved, the sale of this handgun to Detective Hall, will not have a negative impact on the number of available County owned weapons for the Williamson County Sheriff’s Office.
