Discuss, consider and take appropriate action on ratifying spot Purchase Order (PO) #179796 in the amount of $112.500, and approving spot Purchase Requisition #128143 in the amount of $120,000, for Flex Base, from Central Texas Stone and Aggregate LLC.
Background
According to the Brooks treatise: “the county would still be able to make “spot purchases” [of road materials] in the event that the contract supplier is unable to perform, so long as such purchases are not done in a manner to avoid competitive bidding.” 36 Tex. Prac., County and Special District Law § 18.11 (2d ed.). Due to this being time critical to allow for County operations to continue, spot purchases are being facilitated while a new solicitation is accomplished and a new contract awarded. The initial spot purchase PO was issued on January 14, 2022, due to the current contractors not being able to provide product at that time. The second spot purchase is in the queue awaiting approval. Both Flex Base vendors were terminated per 02.01.2022 Commissioners Court session, agenda item #23. Funding Source: 01.0200.0210.003551. New solicitation was issued on 02.15.2022.
