Discuss, consider, and take appropriate action regarding the Standard Utility Agreement with Flint Hills Resources Corpus Christi Pipeline for utility relocations on the FM 3349 Project, a Road Bond Project in Commissioner Precinct 4.
Background
Flint Hills Resources Corpus Christi Pipeline has existing facilities in conflict with the FM 3349 at US 79 Project. The Standard Utility Agreement for the relocations is for a total amount of $6,392,586.44. Flint Hills Resources Corpus Christi is 98.43% eligible for reimbursement. The total anticipated reimbursement to Flint Hills Resources Corpus Christi by the County is $6,292,222.83 (98.43% of $6,392,586.44).
An advanced funding agreement (AFA) with TxDOT is planned to reimburse the County for 90% of the amount eligible for reimbursement, or $5,663,000.55 (90% of $6,292,222.83). There is available budget in the project for the remaining 10% of the utility relocation, or $629,222.28 (10% of $6,292,222.83).
