Recommended Action

  1. Approve second amendment to Agreement No. 20-224 with Heidi Tschudin, doing business as Tschudin Consulting Group, to increase the maximum compensation by $235,651 and modify the scope of work; and
     
  2. Adopt a budget resolution increasing the 2021-2022 budget for the Cache Creek Area Plan by $200,000.

Reason for Recommended Action/Background

Agreement No. 20-224
On September 1, 2020, the Board of Supervisors approved a three-year agreement with Tschudin Consulting Group in the amount of $400,000 to provide contract planning services in support of the Cache Creek Area Plan for the period of July 1, 2020, through June 30, 2023 (Minute Order No. 20-106; Item No. 9). 

First Amendment (Agreement No. 20-292)
On December 15, 2020, the Board of Supervisors approved a First Amendment to Agreement No. 20-224 to increase the maximum compensation by $77,000 and modify the scope of work to add a sub-task to provide contract planning services necessary for the processing of the CEMEX Cache Creek Mining Permit & Reclamation Plan Amendment application (ZF #2018-0015) (Minute Order No. 20-160; Item No. 13).

Proposed Second Amendment
At this time, Staff is recommending the Board of Supervisors approve a Second Amendment to Agreement No. 20-224 to increase the maximum compensation by $235,651 and modify the scope of work.  The increase in maximum compensation is to cover contract planning expenses related to Task 2 - Mining Permit Processing, specifically for the Teichert Shifler Mining and Reclamation Project (ZF #2018-0078); the CEMEX Cache Creek Mining Permit & Reclamation Plan Amendment (ZF #2018-0015); and the CEMEX Minor Modification Application (ZF #2022-0037).  All expenses related to these services are reimbursable from fees collected by the Department of Community Services from the respective applicants.  Staff is also requesting that the scope of work be modified to include contract planning services related to the aforementioned Minor Modification application that was submitted by CEMEX on April 13, 2022.

Staff from the County Administrator's Office collaborated with the Department of Financial Services, the Department of Community Services, and the Office of County Counsel during the development of this amendment. 

Competitive Bid Process/Vendor Performance

Agreement No. 20-224 was the result of an RFQ for Contract Planning Services in Support of the Cache Creek Area Plan (AUDRFQKK2010).

Vendor Performance

The County Administrator's Office confirms that Tschudin Consulting Group has performed satisfactorily on the current agreement.

Staff anticipates that $200,000 of the $235,651 increased maximum compensation will be expensed during FY 21-22. Remaining expenditures will be budgeted appropriately in the FY 22-23 budget. All costs associated with this amendment will be billed on a time-and-material basis. Additionally, expenses associated with the contract increase will be reimbursed through application fees collected by the Department of Community Services' Planning Division by the respective applicants.
