Recommended Action
- Approve third amendment to Agreement No. 20-198 with Northern Recycling for organic waste services at the landfill to revise the compensation section and site lease boundary for the planned composting facility; and
- Authorize the Chair of the Board of Supervisors to sign the amendment.

Reason for Recommended Action/Background
On April 23, 2019, the Board authorized the submittal of a proposal to the City and County of Sacramento and the City of Folsom for Organic Material Diversion Services and on February 9, 2021 the County entered into an agreement with Sacramento County (Agreement No. 21-37) for up to 30,000 tons of organic waste annually. The organic material diversion services proposal was submitted in partnership with Northern Recycling (Northern) as part of the planned development of a new composting facility at the landfill. Construction of this composting facility is near completion with a planned operation date of July 1, 2022. The original agreement with Northern Recycling (Agreement No. 20-198) did not include the necessary provisions to ensure Northern complies with the requirements of the Sacramento County Agreement, and did not incorporate provisions to compensate Northern for this portion of their work. The third amendment to Agreement 20-198 includes these necessary provisions.
As part of the design of the new composting facility, some minor modifications to the site lease granted Northern Recycling under Agreement No. 20-198 were necessary. The previous boundary included two ponds, one for stormwater and one for wastewater. To gain regulatory approval from the Regional Water Quality Control Board, two wastewater ponds and one stormwater pond were required. The new site lease boundary includes the area necessary for the additional pond.
The divisions proposed 2022/2023 budget already includes the revenue and expenditures related to the Sacramento County organic waste, therefore there is no additional fiscal impact for this amendment.

Competitive Bid Process/Vendor Performance
Agreement No. 20-198 was the result of several years of negotiation to close the existing Zamora composting facility and relocate its operation to the landfill.
