Reason for Recommended Action/Background
Staff recommends the appointment of Karleen Jakowski as the County’s Mental Health Director, as a Licensed Clinician is required to be designated by State law and the Government Code and meet the County’s obligation under California Code, Welfare and Institutions Code - WIC § 5604.
Staff recommends the appointment of Ian Evans to Public Guardian. As per Government Code 27431, (a) the board of supervisors may appoint a public guardian to fill the office and provide for appointment to the subordinate positions. (b) In appointing the public guardian, the board of supervisors may give preference to the person or agency providing public guardian services in each county. No person or agency shall be designated as public guardian whose agency functions present real conflict with the functions of conservatorship investigation or administration.
The Public Employees' Pension Reform Act of 2013 (PEPRA) and Government Code 7522.56 & 21224 requires that individuals who retire from a CalPERS agency wait 180 days before being reemployed by the same or another CalPERS Agency unless the individual chooses to reinstate from retirement. Government Code 7522.56 allows exceptions to this 180-day waiting period under certain circumstances including rehiring retirees in an extra help status to perform work of limited term duration and limited term special project work. Staff recommends approval of the attached CalPERS Resolution to allow the hire of one retired annuitant, Margaret Raley, for the County Administrator's Office, to provide administrative support to the HR professional who will conduct an unrepresented compensation study for the County.
Board approval of the attached Resolution providing for At Will Appointments to County Positions is required when changes are made to the list of class titles that are exempt from the requirement that all appointments to regular County positions be made from an eligible list, and who serve at the pleasure of the appointing authority.
