Reason for Recommended Action/Background

The purpose of the attached resolution is to clarify and restate the County's offers of funding support for the Capay Valley Health Clinic and Community Center (CVHCC), a project undertaken by the Yocha Dehe Wintun Nation in the unincorporated community of Esparto. As the Board is aware, the project is intended to provide critical health care and social welfare services to rural residents, primarily serving the Esparto, Madison, and Capay Valley areas. At various points in project planning, including in September 2021 and May 2022, the Board of Supervisors expressed support for the project and took other related actions over time to identify up to $5 million in potential County funding support (primarily with American Rescue Plan (ARP) funds). In addition, Yocha Dehe and the County successfully collaborated to obtain a $6.5 million appropriation of state funding for the project; this funding is expected to flow through the County.

The County and Tribe have not concluded an agreement on the Tribe's acceptance or use of the funding described above. The resolution authorizes staff, including the County Administrator, County Counsel, and Chief Financial Officer, to develop an agreement with the Tribe to enable its formal acceptance and use of the County and state funding on mutually agreeable terms and conditions. The resolution provides some flexibility to staff in developing the proposed agreement, including evaluating previously identified funding sources and determining (subject to Board approval) if any changes in funding source should be considered due to the passage of time and legal considerations (e.g., evolving Treasury guidance on ARP funding) applicable to those sources since initial consideration of project funding. The funding agreement will return to the Board with a budget resolution, as needed, for final approval once negotiations conclude.
