Recommended Action
- Approve Amendment 2 to Agreement No. 18-273 with Gallaway Enterprises, Inc. to add environmental work resulting from CEQA project review for the County Road 98 Bike and Safety Improvement Project, Phase II that was not originally contemplated, but is now necessary to satisfy mitigation needs, and increasing the total contract amount by $26,000 for this additional work; and
- Authorize the Interim Director of Public Works to sign the Amendment.

Reason for Recommended Action/Background
The CR 98 Bike and Safety Improvement Project, Phase II (Project) will extend the improvements completed in 2014 between Woodland and County Road 29 southward to the Solano County line. The Project has received federal transportation funding for preliminary engineering and project development, right of way and construction through the Sacramento Council of Governments (SACOG) in the amounts of $2,364,782, $4,180,00, and $8,725,000, respectively.
On December 11, 2018 the Board of Supervisors approved an agreement with Gallaway Enterprises, Inc., to provide environmental services for the Project. Since then, the Board of Supervisors approved the IS/MND on April 26, 2022 as the appropriate level of environmental review in accordance with the California Environmental Quality Act (CEQA) and Caltrans approved the Natural Environment Study (NES) required by the National Environmental Policy Act (NEPA) on January 27, 2021. Both documents determine mitigation measures that must be implemented to move the Project forward in compliance with CEQA and NEPA.
Approval of Amendment 2 to the Gallaway Enterprises agreement will provide enough funds to perform the tree survey needed to determine the number and size of native trees to be removed and comply with the requirement to mitigate for native trees. This survey was not originally contemplated but is now determined necessary to satisfy the Project's environmental mitigation requirements. The amendment adds $26,000 to the contract and increases the maximum compensation to $129,495.62.
The Department confirms Gallaway Enterprises, Inc., has performed satisfactorily on the current agreement.

The amount budgeted in the FY 2022/23 Road Fund budget for the Project is sufficient to cover the cost of the recommended actions. Federal transportation funds will reimburse the Road Fund at 88.53% for a maximum of $23,028. The minimum matching local funds required are $2,982.
