Recommended Action
Authorize the Yolo County Procurement Manager to execute the fourth amendment to Agreement No. 16195 with California Forensic Medical Group (CFMG) to extend the term of the Agreement through June 30, 2023, and increase funding in an amount of $391,597.49; by adding $337,983.80 of County general funds and $53,613.68 of Medication Assisted Treatment (MAT) funds for 2022-23 for a potential contract maximum of $3,887,630.55, for the provision of comprehensive behavioral health services to the detainees of the Yolo County Jail and Juvenile Detention Facility, for the term of December 1, 2016, through June 30, 2023.

Reason for Recommended Action/Background
Yolo County is mandated to provide effective and quality comprehensive behavioral health services to detainees of the Yolo County Jail and Juvenile Detention Facility (Yolo Jail Facilities). On or about December 3, 2015, the Health and Human Services Agency (HHSA) in collaboration with the County Administrator’s Office (CAO), the County Probation Department (Probation), and the Sheriff’s Office (Sheriff), issued a Request for Proposal (RFP) soliciting a provider of professional behavioral health services for the detainees in the Yolo Jail Facilities.
Ultimately, the resulting agreement was awarded to California Forensic Medical Group, Inc. (CFMG), and thus on or about November 22, 2016, the County and CFMG entered into Agreement No. 16-195 (“Agreement”) for the provision of behavioral health services at the Yolo Jail Facilities, effective December 1, 2016.
CFMG and the County have amended the agreement several times over the course of its term for a variety of reasons. Mostly notably, on or about April 12, 2022, the County and CFMG amended the Agreement to add Medication Assisted Treatment (MAT) Services. MAT services include the use of FDA-approved medications, in combination with counseling and behavioral therapies, to treat substance use disorders as a medical disorder. The MAT program provides addiction treatment and recovery within correctional facilities. MAT also provides opioid addiction and other substance use disorders in more than 70 correctional facilities.
Through the pandemic, there was an increase in the average daily jail population, and the recognition by multiple county departments to increase MAT support was critical. The need for additional medical and behavioral health services in the jail has increased over the past year. In order to meet the increased needs of the inmate population, HHSA worked with CFMG to provide additional medical and behavioral health staffing to the jail. The increased staffing has allowed inmates to continue to receive effective and comprehensive medical and behavioral health services.
Now, HHSA in collaboration with the CAO, Probation, and Sheriff, requests an extension of the Agreement through June 30, 2023, adding funding in the amount of $391,597.49 for FY 2022-23. This extension will allow time for an RFP to be released in FY2022-23, reduce the risk of a contract lapse, and ensure continued compliance with federal and state regulations. The increase for behavioral health services is $337,983.80 (County General Fund), and the increase for MAT services is $53,613.68 (MAT funding).
HHSA believes it is in the best interest of the County to extend this Agreement based on satisfactory service and to avoid the interruption of County business. A formal procurement for these services is planned for late FY2022-23.

Competitive Bid Process/Vendor Performance
On December 3, 2015, HHSA issued Request for Proposal (RFP) for soliciting the professional behavioral health services for the inmates in Yolo County Jail and JDF. A Review Team composed of representatives from HHSA, Probation, Sheriff, the County Administrator’s Office, and an outside agency evaluated responses to the RFP received by HHSA. The proposal submitted by CFMG was adjudged the strongest out of all submissions.
HHSA confirms CFMG has performed satisfactorily on the current agreement. Thus, pursuant to the authority provided to the Yolo County Procurement Manger as the Yolo County Purchasing Agent under the current Yolo County Procurement Policy, the Procurement Manager has determined that it is in the best interest of the County to extend this Agreement, based on satisfactory service and to avoid the interruption of County business. A formal solicitation for these services is planned to be released in FY 2022-23 for a targeted contract start date of July 1, 2023.
HHSA confirms CFMG has performed satisfactorily on the current agreement. Thus, pursuant to the authority provided to the Yolo County Procurement Manger as the Yolo County Purchasing Agent under the current Yolo County Procurement Policy, the Procurement Manager has determined that it is in the best interest of the County to extend this Agreement, based on satisfactory service and to avoid the interruption of County business. These services will be funded by County General Funds and MAT funding. The action increases the contract maximum in an amount of $391,597.49 for a revised contract maximum of $3,887,630.55 for the period of December 1, 2016 through June 30, 2023. The 2022-23 HHSA Adopted Budget included $340,520 for this expenditure, which was based on the pricing in the third amendment to Agreement No. 16-195 approved in April 2022. A budget resolution to appropriate an additional $14,351 in MAT funds and $270,953 in Public Safety Contingency funds for the fourth amendment to Agreement No. 16-195 and the fifth amendment to Agreement No. 16-194 is included in a separate item on the Board agenda for December 6, 2022.
