Recommended Action
- Approve agreement with Marvin L. Crawford Jr., in the amount of $60,300, for acquisition of a permanent drainage easement and a temporary construction easement for the Knights Landing Drainage Infrastructure Improvements Project; and
- Authorize the Director of Public Works to sign the agreement, approve payment, open escrow, accept the easement, record the deeds once the signed deeds have been received and escrow has closed, and take other actions necessary to complete the acquisition of the easements.

Reason for Recommended Action/Background
In 2017, Yolo County received a grant from the California Department of Water Resources' ("DWR") Small Communities Flood Risk Reduction Program ("SCFRRP") to complete a feasibility study of structural and non-structural actions that could reduce flood risk to the town of Knights Landing. The County prepared the 2019 Knights Landing Small Community Flood Risk Reduction Feasibility Study as a deliverable for the grant.
In 2020, the County received additional grant funding from DWR as part of Phase 2 of the SCFRRP to implement the Knights Landing Flood Management Project, which consists of the design, environmental documentation, permitting, real estate, and construction activities required to improve the conditions of the existing State Plan of Flood Control levees that protect Knights Landing, as well as ecosystem restoration and enhancement. When the Knights Landing Flood Management Project is completed, it will reduce or prevent flooding to a population of 995 County residents, approximately 321 structures, and 3,400 acres of prime agricultural lands.
The Project contains four elements - one of which is the design, permitting, and construction of drainage infrastructure improvements within the town. This project element is the focus of this staff report.
Project Description

Project Description

This project is referred to as the Knights Landing Drainage Infrastructure Improvements Project ("Project"). The Project is designed to incorporate the following features:
- road-side ditch improvements along 2nd Street between the Post Office and Railroad Street to improve storm water drainage capacity;
- a buried closed conduit under Railroad Street between 2nd Street and 4th Street (approximately 2.25-feet-wide by 1-foot-deep);
- an open channel along the east side of Railroad Street between 4th Street and 7th Street (approximately 3-feet-deep; 2:1 side slopes);
- the removal of the existing concrete arch culvert; and
- the degrade of the abandoned railroad embankment using a 50-foot-wide open cut channel.

Environmental Review
An Initial Study/Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program for the Project was adopted by the Board of Supervisors on May 10, 2022 (Minute Order No. 22-57; Item No. 11). A Notice of Determination was filed with the County Clerk-Recorder and the State Clearinghouse in compliance with Section 21152 of the Public Resources Code on May 12, 2022 (Document No. 57-05122022-054). A State Clearinghouse Number of 2022030394 was attributed to this Project.
Procurement and Real Estate
On August 30, 2022, the Board of Supervisors adopted the plans and specifications for construction of the Project and authorized the Department of Community Services ("Department") to advertise for competitive bids, in addition to other procurement related actions (Minute Order No. 22-89; Item No. 9).
The Department plans to go out to bid for this Project in Summer 2023; however, all outstanding real estate related items must be complete in order to do so. One such outstanding item is the acquisition of a permanent drainage easement and a temporary construction easement on APN 056-334-001 (Att. B). The subject property is a 0.45-acre tract of residential land located at the northeast corner of Railroad Street and County Road 116 located near the southernmost portion of the project. The property is owned by Mr. Marvin L. Crawford Jr.
An independent appraisal was prepared by CBRE Valuation & Advisory Services to determine the value of the easement interests the County must acquire for the Project. In accordance with federal requirements for property acquisition, just compensation was established by the County based on this appraisal. County staff, and its consultant team, worked with Mr. Crawford Jr. to come to a mutually acceptable agreement for the purchase of the easements and compensation.

At this time, staff is requesting that the Board of Supervisors approve the agreement with Marvin L. Crawford Jr., in the amount of $60,300, for acquisition of a permanent drainage easement and a temporary construction easement for the Knights Landing Drainage Infrastructure Improvements Project (Att. This item falls under Task 5 (Real Estate) of the County's Funding Agreement with DWR for the Knights Landing Flood Management Project. Task 5 has a cost share split of 90% State and 10% Local. Based on this split, the cost share of the proposed easement acquisitions is as follows:

- County: $6,030 (paid via the Knights Landing Levee Capital Project Fund)
All expenditures related to this item are accounted for in the adopted FY 22-23 budget.
