Approve the request of the Davis Joint Unified School District to call a special election and the consolidation of the special election with the community services district elections in the November 7, 2023 Uniform District Election Law (UDEL) Election. (No general fund impact) (Salinas)

Recommended Action

Approve the request of the Davis Joint Unified School District to call a special election and to consolidate with the community services districts in the Uniform District Election Law (UDEL) Election on November 7, 2023, as permitted under the California Elections Code section 10400 et seq.

Reason for Recommended Action/Background

  1. Davis Joint Unified School District has a vacancy in Trustee Area 5 due to the resignation of the governing board member on June 15, 2023. The Davis Joint Unified School District governing board adopted Resolution NO. 66-23 to order an election pursuant to Education Code section 5091(a)(1) to fill the vacancy and to consolidate with any and all elections also called to be held on November 7, 2023 pursuant to Education Code sections 5091(b), 5322, and 5342 and Elections Code sections 1000 and 10002. Trustee Area 5 is located in both Solano and Yolo Counties.
     
  2. The following community services districts have ordered an election and requested consolidation of their district election with the November 7, 2023 election.
    1. Cacheville Community Services District
    2. Esparto Community Services District
       
  3. Elections Code sections 10401 et seq. permit the Board of Supervisors to consolidate the elections of any legislative or congressional district, public district, city, county or other political subdivision called to be held on the same day with the regular statewide election. This will help reduce the cost of their election and potentially increase voter turnout.
     
  4. If the number of nominees for office do not exceed the number of offices to be filled at the district election, the contests will not be on the ballot. In accordance with California Elections Code §10515, the nominees who filed a declaration of candidacy before the end of the nomination period shall be appointed by the Board of Supervisors.
