Recommended Action

Approve and authorize the Yolo County Procurement Manager to execute the fourth amendment to Agreement No. 22-172 with California Forensic Medical Group to extend the term of the agreement through October 31, 2023; and increase funding in an amount not to exceed $256,648.19, for a new contract maximum of $1,306,350.74, for the period of March 1, 2022 through October 31, 2023, for the provision of Jail Based Competency Treatment.

Reason for Recommended Action/Background

Over the past several years there has been a steady increase in the amount of felony incompetent to stand trial clients being referred to the Department of State Hospital for competency restoration without adequate capacity in the existing State Hospitals.  This has led to a significant backlog of clients throughout the State waiting in jails for months at a time until placement can be made at a State Hospital bed.  As a result, the Department of State Hospitals has been working with the State and various counties to increase statewide capacity for local treatment options.  These options include Jail Based Competency Treatment programs. 

On or about July 12, 2022, the County entered into an agreement with the State of California, Department of State Hospitals (“DSH”), State Agreement Number 19-79013-000 (“Yolo/DSH Agreement”), for administration of a Jail Based Competency Treatment (“JBCT”) program. The purpose of the JBCT program is to restore competency to certain felony patient inmates deemed incompetent to stand trial (“IST”) under Penal Code section 1370. JBCT program service are provided locally at the Monroe Facility rather than in a State Hospital facility.

On or about July 12, 2022, the County entered into an agreement with California Forensic Medical Group (CFMG), the current jail medical service provider for the County. CFMG is a qualified inmate medical services provider who agreed to provide services to assist the County with its JBCT program. CFMG has provided services to seven beds at the Monroe Facility. The services have been provided 24 hours per day, seven days per week, including all state holidays.
The Yolo/DSH Agreement provides funding for a dedicated Sheriff's Deputy assigned to the JBCT program.  This is a critical component to a JBCT program as there are often individuals receiving JBCT services that have different classifications, require supportive oversight, and having a dedicated Deputy that receives specific training as part of the overall JBCT team increases effectiveness of the program.  The Yolo/DSH agreement also provides the Sheriff Department with funding for the overall housing costs associated with these 7 beds.

A formal solicitation via a request for proposal was issue by the County in March 2023 (“March 2023 RFP”) for a new agreement for these services. CFMG was the only respondent and March 2023 RFP Review Committee determined CFMG met the minimum qualifications of the March 2023 RFP. The extension contemplated herein will allow time for the final contract negotiations with CFMG for the new agreement to be awarded under the March 2023 RFP, with a targeted start date of November 1, 2023.

Negotiations are ongoing and now HHSA in collaboration with Probation, and Sheriff Agencies request authority to extend the Agreement for an additional month through October 31, 2023 and to add funding in an amount of $256,648.19 with delegated signing authority to the Yolo County Procurement Manager to assist with expediting execution of the extension to reduce the risk of a contract lapse and ensure continued compliance with federal and state regulations and avoid any interruption in services to detainees while the new agreement is finalized and executed.

HHSA, Probation, and Sheriff Agencies believe it is in the best interest of the County to extend JBCT Services based on satisfactory service and to avoid the interruption of County business. Approval of the recommended actions will enable the parties to conclude contract negotiating for the new Agreement.

Competitive Bid Process/Vendor Performance

Agreement No. 22-172 was procured via a sole source approved by the Procurement Department, on April 12, 2022.

HHSA, Probation and Sheriff Agencies confirm CFMG has performed satisfactorily on the current agreement. Thus, pursuant to the authority provided to the Yolo County Procurement Manger as the Yolo County Purchasing Agent under the current Yolo County Procurement Policy, the Procurement Manger has determined that it is in the best interest of the County to extend this Agreement, based on satisfactory service and to avoid the interruption of County business. Please note the details re the March 2023 RFP referenced above.
