Ratify agreement with Victor Community Support Services for the provision of Mobile Crisis Response Services for the period of December 31, 2023 through June 30, 2024 in the amount of $300,000. (No general fund impact) (Sullivan)

Recommended Action

  1. Ratify agreement with Victor Community Support Services for the provision of Mobile Crisis Response Services for the period of December 31, 2023 through June 30, 2024 in the amount of $300,000; and
     
  2. Delegate authority to the Director of the Yolo County Health and Human Services Agency or her/his designee to: 1) exercise optional year extensions up to $300,000 per fiscal year for fiscal years 2024-25 and 2025-26 and 2) issue related option year notices. Please see Paragraph III.E. of Att. A. Agreement).

Reason for Recommended Action/Background

On or about June 14, 2022, the County entered into an agreement with Victor Community Support Services to provide Family Urgent Response System (FURS). FURS is a coordinated statewide, regional, and county-level system designed to provide support to current and former foster youth, as well as their caregivers.  FURS requires county child welfare, probation, and behavioral/mental health agencies to establish a joint county-based mobile response system that includes a mobile response and stabilization team to provide in-person support as needed.  This support also includes a toll-free hotline available 24 hours per day, seven days a week, to effectively engage caregivers and children and youth currently or previously in the foster care system who are experiencing tension and conflict in their relationships, emotional distress, or behavioral or other difficulties that may threaten their relationships. Hotline operators will provide immediate assistance over the phone to help defuse conflict and to provide focused engagement and assessment to make a referral to the county mobile response system for further support.

The agreement with Victor Community Support Services had an initial term of April 1, 2022 through June 2024, with two optional extensions for FY’s 2024-25 and 2025-26.

California Advancing and Innovating Medi-Cal (CalAIM) Initiative
In January 2022, California Department of Health Care Services (DHCS) rolled out the CalAIM initiative that aims to provide broad delivery system program and payment reform across the Medi-Cal system. The goal is transformation of the Medi-Cal delivery system, moving it towards a population health approach that prioritizes prevention and whole person care. Focus shifts from compliance to quality and performance metrics. Specialty Mental Health Services (SMHS) requirements and policies pursuant to the CalAIM initiative were updated, and as a result of these updates, the County is required to revise the terms and conditions in the provider agreements for these services. 

The American Rescue Plan Act of 2021 section 9813 (42 U.S.C. section 1396w–6) allowed states to add qualifying community-based mobile crisis intervention services as a covered Medi-Cal benefit for a five-year period, beginning April 1, 2022, and ending March 31, 2027.

DHCS, as a part of its California Advancing and Innovating Medi-Cal (CalAIM) initiatives, amended its State Plan to include community-based mobile crisis intervention services. The County as an MHP is responsible for providing Medi-Cal community-based mobile crisis intervention services (Behavioral Health Mobile Crisis Services) to include screening, assessment, stabilization, de-escalation, follow-up, and coordination with healthcare services and other supports.

While the term of the FURS Agreement goes through June 30, 2024, and provides two optional extensions for FY’s 2024-25 and 2025-26, by adding the Mobile Crisis Response services and the significant regulatory and claiming changes driven by the CalAIM initiative, County and VCSS agree to terminate the Original FURS Agreement effective December 30, 2023, and replace it with this new Agreement effective December 31, 2023.

HHSA requested the County Procurement Manager to sign the Agreement with Victor Community Support Services to expedite the contract execution in order for these services to begin and for the County to be in compliance with DHCS to avoid any sanctions.

Competitive Bid Process/Vendor Performance

On December 15, 2023, the Yolo County Procurement Manager or designee approved a sole/single source procurement for these services. Without the sole source approval of the agreement with the vendor, the County would be out of compliance with BHIN 23-025 and likely face sanctions from DHCS. Factors considered, included but were not limited to:

1) Based on the DHCS Info Notice BHIN 23-025, the County is required to implement a 24/7 operational Medi-Cal Mobile Crisis response team, and requires coordination between FURS and Mobile Crisis so this issue is resolved by keeping the services together; 2) the vendor has been a county vendor for over five years providing successful performance; 3) reducing administrative costs and leveraging existing contracted staff who are already functioning in an 'on call' roll contract with a different vendor would increase admin costs substantially and result in duplication of services; and 4) The County would be out of compliance with and would likely face sanctions from DHCS. The County would not be providing Medi-Cal Mobile Crisis Services Benefit to children and youth 0-17 which would negatively impact the children and families in the county in addition to being in violation of State guidance.

No general funds are required by this action. These services will be funded by FURS and MHSA. The total amount of this action is $300,000 for the period of December 31, 2023 through June 30, 2024. The amount of $300,000 is included in the HHSA adopted budget for fiscal year 2023-24. The related funding will be included in the requested budget process for future fiscal years.

In no event shall the term of the Agreement extend beyond June 30, 2026, nor shall the total contract maximum exceed NINE HUNDRED THOUSAND DOLLARS ($900,000), unless otherwise agreed to in writing by the Parties and in conformity with the then-current Yolo County Procurement Policy approved by the Yolo County Board of Supervisors.
