Reason for Recommended Action/Background

Tobacco Prevention Program staff will provide the Board of Supervisors with an overview of a proposed smoke-free multi-unit housing policy. The presentation outlines the public health rationale, summarizes local data on secondhand smoke exposure, reviews policy options, and highlights potential benefits for residents, property owners, and the broader community. This briefing is intended to inform the Board, answer preliminary questions, and support direction on whether to advance development of a countywide smoke-free multi-unit housing ordinance. This item was presented to the board on November 8, 2022. At that time, the Board directed staff to conduct further research without taking any action on the item.

This proposed policy will apply exclusively to the unincorporated areas of Yolo County and will encompass nine (9) residential complexes (apartments), totaling approximately 259 units. Educational outreach for both the public and property owners will be conducted by the Yolo County Tobacco Prevention Program, utilizing funds from Proposition 56 and Proposition 99. This program will not result in any fiscal impact to Yolo County. If enacted, staff will educate the landlord to follow equitable enforcement as well as provide cessation resources. Following best practices from other jurisdictions that have adopted similar ordinances, enforcement will begin with verbal and written warnings. A minimum of three written warnings must be issued before further action is considered. Each warning will include educational materials and cessation resources. Please refer to Attachment A. Presentation slides 5 and 6 for additional details. In alignment with best practices, enforcement guidelines may be tailored at the discretion of the Board.
