Update regarding extending the protest hearing for the Elkhorn Fire Protection District (FPD) and County Service Area 9 (CSA 9) Reorganization into the Springlake FPD from May 26, 2026 to June 16, 2026 (no action will be taken)

Receive a brief update regarding the protest process for the Elkhorn FPD and CSA 9 Reorganization into the Springlake FPD. Adoption of a resolution certifying protest hearing results will be rescheduled for the June 25, 2026 LAFCo meeting. 

At the April 23, 2026, public hearing, the Commission adopted Resolution 2026-01 approving the Elkhorn Fire Protection District (FPD), Springlake FPD, and County Service Area 9 (CSA 9) Reorganization (LAFCo Application #24-02). Staff mailed notice of the protest hearing and a protest form to registered voters and landowners.

Recently, Staff determined that the landowner mailing list for the Elkhorn FPD affected territory was incomplete and some landowners were not mailed a notice of the protest hearing. The CSA 9 landowner list and registered voter list for both Elkhorn FPD and CSA 9 were unaffected, and the error did not affect the notice for the April 23, 2026 public hearing. To remedy the error, staff has mailed the notice and protest form to all landowners in the Elkhorn FPD affected territory, and extended the protest period until June 16, 2026 to ensure that all landowners receive the minimum 21-day notice period.

After the extended protest period closes, staff will tally the protests and return to the Commission on June 25, 2026, for adoption of a resolution adopting the protest results.
