Recommended Action

Reason for Recommended Action/Background
The current landfill operations contract will expire on May 14, 2022. A new contract must be awarded in order to provide uninterrupted waste disposal services at the Yolo County Central Landfill, which serves the residents of the four cities and unincorporated areas of the County as well as many out of county customers. On February 24, 2015, the Yolo County Board of Supervisors awarded the current landfill operations contract to Geerts Construction based on the firm's excellent past performance, qualifications, and cost as compared to the other proposals.
On December 21, 2021, the Yolo County Department Community Services, Division of Integrated Waste Management released a Request for Proposal (RFP) for operation of the Yolo County Central Landfill. On January 12, 2022, a job site walk was held for interested contractors. Four companies attended (Geerts Construction, Waste Management, Recology and Republic). Three proposals were received by the deadline of February 10, 2022. A four-person committee of division staff reviewed the proposals using the guidelines in the RFP. Geerts Construction was the top ranked proposal and was also the lowest priced proposal. Compared to the second ranked proposal, Geerts Construction’s cost are approximately $750,000 less annually.
Though Geerts construction’s proposal was the lowest priced, it still represents a significant increase over current operations costs of nearly $6.00 per ton (approximately $1.1 million annually). According to Geerts Construction, the majority of this increase ($4.75 per ton) is due to increases in State of California, Department of Industrial Relations mandated prevailing wage increases and heavy equipment fleet replacement to meet California Air Resources board emission requirements for off-road diesel engines included in Title 13, California Code of Regulations, Section 2449. The remaining increases are due to general increase in the cost of doing business.
During final agreement negotiations, it was determined that it would be beneficial to separate a portion of the compensation, specifically for the liquid waste management, into a separate master agreement. This was done to separate the public works portion of the agreement and necessary payment and performance bond coverage from the non-public works portion of the agreement. Both internal and outside counsel developed the two agreements included herein.

This agreement includes up to $3,500,000 annually for compensation related to solid waste placement, compaction and cover, up to $1,000,000 annually for management of the landfill's liquid waste program and up to $750,000 in additional services. Actual expenditures are largely based on the quantity of waste inflow to the landfill. Sufficient funds are being budgeted in FY 2022-2023 for this agreement. Subsequent budgets will include sufficient funds from the sanitation Enterprise fund for this agreement.
