Reason for Recommended Action/Background

Original Agreement
On October 22, 2021, the County and FlowWest, LLC entered into Agreement No. 7676-2022-TAC HYDRAULIC ("Agreement") for FlowWest, LLC to provide hydraulic engineer and fluvial geomorphologist services for the Cache Creek Technical Advisory Committee.  The Agreement included three tasks:
  • Task 1: Cache Creek TAC Geomorphologist Duties
  • Task 2: Cache Creek TAC Hydrualic Engineer Duties
  • Task 3: Huff's Corner FSRP Project

Huff's Corner Levee Raise & Channel Reconfiguration Project
The proposed amendment that is associated with this staff report is related to Task 3 of the Agreement.  FlowWest has been serving as the lead design engineer on the channel reconfiguration portion of the project.  At the time of drafting this staff report, the in-channel project is currently in construction and is anticipated to be finished in mid-November 2022.  When complete, this phase of the project will have removed a large sediment island that has formed over the last several decades in Lower Cache Creek at "Huff's Corner" upstream of Interstate 5.  The in-channel project also involves the realignment of Cache Creek's low flow channel, as well as construction of a sacrificial terrace along the right bank of the creek in an area of the creek that has been subject to severe erosion in the past.

Proposed First Amendment
At this time, Staff is proposing to modify the scope of work for Task 3: Huff's Corner FSRP Project to account for additional services that were provided, and to increase the scope's budget accordingly by a total of $275,320.  

After the project was initially designed, several unanticipated modifications were made to the design in order to address state and federal agency permitting processes.  This lead to additional time spent on the design that was not originally expected.  Additionally, FlowWest was more involved with the competitive bidding process than was originally scoped.  When the in-channel project was put out to bid from August to September 2022, the solicitation received nearly 50 questions from interested bidders during the "Question and Answer" portion of the bidding process.  Many of these questions were technical in nature and required the engineering design team's input.  There were also several questions that lead to changes to the plans and specifications that were developed by FlowWest.  Lastly, FlowWest added two sub-consultants to their team to provide project implementation and environmental compliance services (ECORP Consulting, Inc.) and construction management services (Cal Engineering & Geology).  These sub-consultant services were found to be necessary due to the overall complexity of the project with regard to its construction and compliance with the many conditions imposed on the project by the several state and federal environmental permits that were obtained for it.

As mentioned in the Fiscal Information section below, the additional $275,320 associated with the proposed amendment falls within the current budget of the County's funding agreement with the State Department of Water Resources for this project.

Competitive Bid Process/Vendor Performance

The original agreement was the result of two Request for Qualifications that were released by the County on June 22, 2021.

The Huff's Corner Levee Raise & Channel Reconfiguration Project is funded by an agreement between the County and the State Department of Water Resources (DWR Agreement No. 4600013693). The total project amount is $2,845,000. The agreement between the County and the State establishes a cost share split of 85% State ($2,418,250) and 15% local ($426,750). The local cost share is funded by the Cache Creek Resources Management Plan.

The additional $275,320 associated with the proposed amendment falls within the current budget for the project and the expenses were budgeted accordingly in the CCRMP's FY 22/23 budget; thus, resulting in no fiscal impact.
