Subject

Adopt a Resolution of Acceptance of Parcel Map No. 5226 to create 10 parcels, not less than 80 acres each, from four parcels consisting of approximately 1,055 acres in the unincorporated area of Yolo County. (No general fund impact) (Lindbo/Gonzalez)

Recommended Action

  1. Adopt the Resolution of Acceptance of Parcel Map No. 5226 (Attachment B);
     
  2. Instruct the Clerk of Board of Supervisors to verify that the Tax Collector has signed the map; and
     
  3. Authorize the Clerk of the Board of Supervisors to sign and transmit Parcel Map No. 5226 (Attachment C) to the County Clerk-Recorder for filing.

Reason for Recommended Action/Background

On January 19, 2023, the Yolo County Planning Commission adopted a Mitigated Negative Declaration and approved a Tentative Parcel Map (TPM) request to create 10 parcels, of not less than 80 acres each, from four parcels consisting of 1,055 acres to allow the property owner to create lots that more appropriately align with the boundaries of the existing farming operations, meet the conditions imposed by a previously-filed Conditional Certificate of Compliance, resolve outstanding errors on the title report, and simplify crop insurance reporting. For additional project detail, please refer to the Planning Commission staff report in Attachment D.
 
The Project site is designated Agriculture (AG) by the 2030 Countywide General Plan and zoned Agricultural Intensive (A-N)/Clarksburg Agricultural District (CAD) Overlay. Historically, the site has been cultivated in seasonal row crops, irrigated via surface and well water supplies. The Project site consists of four parcels that lie within the Primary Zone of the Delta north of Winchester Lake along Pumphouse Road near the community of Clarksburg. No development is proposed as part of the Parcel Map, no existing easements will be affected, and the majority of the property is enrolled in a single Williamson Act contract (No. 70-202). An updated Williamson Act contract will be prepared to enroll additional acreage following acceptance of a Parcel Map by the Board of Supervisors.
 
The Project is consistent with policies in the 2030 Countywide General Plan that aim to maintain parcel sizes large enough to sustain agricultural production (parcel sizes range from 80 acres to 153 acres) and prohibit the division of agricultural land for non-agricultural purposes and uses. Furthermore, the Project was reviewed by the Delta Protection Commission and has been determined to be consistent with the Land Use and Resource Management Plan (LURMP). The Applicant has satisfied all conditions placed on Tentative Parcel Map No. 5226 and has submitted the final Parcel Map for acceptance by the Board of Supervisors.
 
The final Parcel Map was deemed technically correct by the County Surveyor on June 8th, 2023. Staff supports the approval of the Project because the Parcel Map meets the Agricultural Intensive (A-N) zone minimum parcel size requirements to retain viable agricultural parcels and satisfies the intent and policies of the 2030 Countywide General Plan that governs the division of agricultural lands.

Pursuant to Section 15268 of the California Environmental Quality Act (CEQA) Guidelines, the approval of a Parcel Map is exempt from the requirements of CEQA as a ministerial project.
