Recommended Action

Approve sixth amendment to the agreement with University of California, Davis Health to extend it through December 31, 2024 and add funding in the amount of $51,383.04 for a new contract maximum of $779,721.92, for the period of July 1, 2014 through December 31, 2024, for the provision of EMS Agency Medical Director services.

Reason for Recommended Action/Background

Per the California Code of Regulations & California Health & Safety Code, every local Emergency Medical Service (EMS) Agency shall have a full or part-time licensed physician and surgeon as a medical director who has substantial experience in the practice of emergency medicine. Medical Directors are to provide medical control and assure medical accountability throughout the planning, implementation, and evaluation of the EMS system.

An agreement with UC Davis Health was executed effective July 1, 2014 for these EMS Medical Director services. EMS Medical Director services provided to Yolo County under this agreement include but are not limited to: monitoring the performance of the Yolo EMS system; advising the EMS Agency Administrator on the status of the Yolo EMS system relative to the requirements of CA Health and Safety Code Division 2.5, Section 1797.200 et. seq. and with other projects associated with quality improvement of the Yolo EMS system; developing and overseeing the medical treatment protocols used by pre-hospital and interfacility transport personnel in Yolo County; and attendance and participation at related committee meetings.

The Deputy Director of the General Services Department/County Procurement Manager acting as the County Purchasing Agent (Yolo County Procurement Manager) advised that a formal solicitation is warranted for these services. HHSA EMS staff are working with the General Services Department, Procurement Division on a formal solicitation. In the meantime, HHSA staff requests approval of this amendment to extend this EMS Medical Director services agreement through December 31, 2024, so these mandatory services can continue while a formal solicitation is completed and a new agreement is established. The Yolo County Procurement Manager determined that it is in the best interest of the County to extend this agreement for six months, based on satisfactory service and to avoid the interruption of County business while such formal solicitation is being completed.

Performance Measures are not originally associated with this Agreement. HHSA EMS staff will review the services provided and determine if performance measures are to be included in the new agreement established as a result of the formal solicitation.

Competitive Bid Process/Vendor Performance

On June 16, 2014, the then acting Yolo County Purchasing Agent/Procurement Manager approved a single source procurement for EMS Medical Director services and the EMS Medical Director agreement was subsequently executed. On June 6, 2017, the then acting Yolo County Purchasing Agent/Procurement Manager approved a new single source procurement for the EMS Medical Director services, so the agreement could be extended through June 30, 2018 via the third amendment. On April 21, 2023, the then acting Yolo County Purchasing Agent/Procurement Manager approved a new single source procurement for the EMS Medical Director services, so the agreement could be extend through June 30, 2024 via the fifth amendment. This additional extension of the EMS Medical Director agreement through June 30, 2024 was required so these mandatory services could continue while the new 911 ambulance service agreement was being negotiated. An extension of the EMS Medical Director agreement was warranted because there was the potential for impacts to its scope of work based on the outcome of the negotiations for the 911 ambulance service agreement. Thus, it was deemed appropriate to complete the formal solicitation and contract negotiations for the 911 ambulance service agreement before issuing a formal solicitation for the EMS Medical Director services. On or about April 15, 2024, Agreement No. 24-33 was executed with Advanced Life Support and Critical Care Transports for 911 Ambulance Services, thus allowing the formal solicitation process for EMS Medical Director services to begin. A formal solicitation for these services was released September 5, 2024 for a targeted contract start date of January 1, 2025.

HHSA confirms the Regents of the University of California, acting for and on behalf of the University of California, Davis Health, has provided, without interruption, a licensed physician with substantial experience in the practice of emergency medicine to serve as the Medical Director for the ongoing implementation and evaluation of the EMS system. Thus, the Yolo County Deputy Director of the General Services Department/County Procurement Manager acting as the County Purchasing Agent has determined that it is in the best interest of the County to extend this Agreement for six months, based on satisfactory service and to avoid the interruption of County business while the formal solicitation is being completed.

No general funds are required by this action. These services will be funded by EMS-P. The action increases the contract maximum by $51,383.04 for a total of $779,721.92 for the period of July 1, 2014 through December 31, 2024. The amount of $51,383.04 is included in the HHSA adopted budget for fiscal year 2024-25.
