Hold a public hearing and adopt resolution approving the Engineer's Report, confirm diagram and assessment, and order the continued levy of Clarksburg Lighting District Assessment for fiscal year 2025-2026. (No general fund impact) (Webb/Pavlova) (Est. Time: 5 min)

Recommended Action

  1. Hold a public hearing;  
     
  2. Adopt resolution approving the Engineer's Report and ordering levy of continued Clarksburg Lighting District Assessment for fiscal year 2025-2026 (Attachment A); and
     
  3. Direct the Clerk of the Board to file a certified copy of the diagram and assessment and a certified copy of this resolution with the Auditor of the County of Yolo.

Reason for Recommended Action/Background

The Clarksburg Lighting Assessment District was established in August 1982 under the Landscape and Lighting Act of 1972, with the adoption of Resolution 82-108. The Assessment District is responsible for providing street lighting for the community of Clarksburg. The streetlights are operated and maintained by Pacific Gas and Electric Company (PG&E) and the streetlight service provided within the District for the benefit of the District is funded from an annual assessment.  In 2021, after gaining property owner ballot support, the benefit assessment was increased from $22 to $35 per parcel to continue providing lighting services to Clarksburg (Resolution No. 21-151) with annual CPI adjustments up to 5% per year. The timeline of events can be summarized as follows: 
  • Ballot Conducted: September to November 2021
  • Ballot results: 71.8% of the property owners cast ballots in support of the proposed assessment
  • Fiscal Year 2022-2023 Approved Rate: $35 per parcel
  • Fiscal Year 2023-2024 Approved Rate: $37 per parcel
  • Fiscal Year 2024-2025 Approved Rate: $38 per parcel 
  • Fiscal Year 2025-2026 Proposed Rate: $39 per parcel
  • Annual CPI Adjustment: In each subsequent year, the maximum assessment rate increases by the annual change in the Consumer Price Index (CPI-U) for the San Francisco-Oakland-San Jose, CA area for the most recent February to February as compiled by the Bureau of Labor statistics or five percent (5%), whichever is lower. The rate is to be rounded to the nearest dollar.
The change in the CPI from February 2024 to February 2025 is 2.7%. Therefore, the maximum authorized assessment rates for Fiscal Year 2025-26 have been increased by 2.7%, rounded to the nearest whole dollar, and the maximum authorized assessment rate is $39.00 per parcel (an increase of $1.00 from last fiscal year). 

The Landscaping and Lighting Act of 1972 requires that an annual Engineer’s Report be prepared by a licensed professional engineer and establishes other requirements for the continuation of the assessments. The Engineer's Report has been prepared by Yolo County Public Works' registered, professional engineer and submitted to the Board, in which an assessment is proposed to fund the cost of the maintenance and operations of the Clarksburg streetlights within the Assessment District boundaries (Attachment B). The proposed assessment rate for the 2025-2026 fiscal year is $39.00 based upon the Engineer's Report and the cost projections therein. On May 20, 2025, the Board of Supervisors preliminarily approved the Engineer's Report, provided notice of the Board's intention to continue levying the assessment with the inflationary adjustment, and provided notice for the required Public Hearing on July 8, 2025. 

Adoption of the resolution approving the Engineer's Report and ordering levy of a continued Clarksburg Lighting District assessment for fiscal year 2025-2026 will result in the continuation of the levy assessments for fiscal year 2025-26 and will cause these levies to be submitted to the County Auditor to be included in the 2025-26 property tax bill. This public hearing will allow all interested persons the opportunity to participate in this decision-making process and will allow the Board of Supervisors to consider all oral statements and all written protests made or filed by any interested person.

There is no general fund impact associated with this action. Additional revenues have been included in the Clarksburg Lighting Assessment District FY 2025-26 Recommended Budget. The FY 2025-26 Recommended Budget Hearing was held on June 10, 2025.
