Recommended Action
- Receive and file Capay Cemetery District Board of Trustees Resolution (Att. A.);
- Hold a public hearing and approve an increase to the membership of the Capay Cemetery District Board of Trustees from three to five members; and
- Adopt a Resolution approving the increase in the membership of the Capay Cemetery District Board of Trustees from three to five members and authorizing related actions (Att. B.).

The Capay Cemetery District ("District"), pursuant to the Public Cemetery District Law (Health & Safety Code Sections 9000-9093), currently has a three-person Board of Trustees appointed by the County Board of Supervisors, which serves as the governing body of the District. A typical cemetery district board consists of three or five trustees. In the interest of expanding their opportunities for community engagement, the Capay Cemetery District now seeks an expansion of their Board from three to five members.
On July 9, 2025, the District's Board of Trustees adopted a resolution requesting the County Board of Supervisors to increase the number of trustees from three to five, as permitted by Health & Safety Code Section 9025(a) (Att. A.). The District's resolution also requests one trustee be appointed to an initial staggered term of two years and one trustee to a term of four years to the Capay Cemetery District Board of Trustees. After the initial terms, the appointed Trustees will serve four-year terms consistent with Health & Safety Code Section 9024(a).
If the resolution is adopted by the Board of Supervisors approving the increase in the District's Board of Trustees to five members, a recruitment for the new vacancies shall occur. Staff will return to the Board for approval and appointment of the new Trustees.
