Recommended Action

Approve Yolo Organized Crime Drug Enforcement Task Force Cost Reimbursement Agreement with the FBI and grant the Yolo County Sheriff’s Office signature authority on program-related documents; with terms to remain in effect through September 30, 2021.

Reason for Recommended Action/Background

The FBI’s State and Local Overtime Program (SLOT) is designed to reimburse overtime costs incurred by officers working on federal Organized Crime Drug Enforcement Task Force (OCDETF) cases.  The OCDETF program was established in 1982 to combat transnational organized crime, money laundering, and major drug trafficking networks.  In 2017, the OCDETF mission expanded to include multi-agency alignment, allowing local law enforcement officers to assist in investigations, strategic initiatives, and prosecutions.  This coordination of efforts between agencies increases the effectiveness and productivity of law enforcement by avoiding duplication of investigations in matters of concurrent jurisdiction by combining local law enforcement activity with more complex methods of investigation utilized by the FBI. 
 
The Yolo OCDETF Cost Reimbursement Agreement delineates the responsibilities of the task force personnel and formalizes the reimbursement process.  The Sheriff’s Office will have one officer part-time detailed to the OCDETF and will be responsible for all personnel costs.  If the officer works 0-7 regular hours on OCDETF matters in one month, the FBI will reimburse up to 16 hours of OCDETF overtime hours worked for that month. If the officer works 8-79 hours on OCDETF matters in one month, the FBI will reimburse all OCDETF overtime hours needed for that month.  The overtime reimbursement rate is limited to the authorized overtime rate of the participating officer and shall not exceed 25% of the current approved Federal salary rate in effect at the time the overtime is performed. Terms of the Cost Reimbursement Agreement shall remain in effect through the end of the 2021 federal fiscal year.
 
Because Cost Sharing Agreement is between government entities, Board of Supervisors approval is now requested.

The Yolo County Sheriff’s Office will seek reimbursement from the FBI only if the part-time deputy assigned to the OCDETF incurs overtime expenses working on OCDETF related matters. The overtime rate will be calculated at the actual cost for the individual officer at a not-to-exceed amount of $3,000 for the life of the Agreement.
