Recommended Action

Approve seventh amendment to Agreement No. 19-242 with Willow Glen Care Center to add funding in the amount of $122,000 for fiscal year 2021-22, for a new contract maximum of $4,388,111, for the period of July 1, 2017 through June 30, 2022, and to update and clarify language in the Agreement, for the provision of 24-hour residential care services.

Reason for Recommended Action/Background

On or about August 14, 2017, the County entered into an agreement, otherwise known as Agreement No. PO 2425 (“the Agreement”), with Willow Glen Care Center. Willow Glen Care Center is a nonprofit 501(c)(3) corporation located in Northern California. Initially, the County entered into the Agreement to have Yolo County Medi-Cal eligible clients aged 18 and above who are diagnosed with a serious mental illness (SMI) treated at the Willow Glen Care Center’s residential care programs.
 
Willow Glen Care Center’s residential care programs provide a less restrictive environment compared to an Institute for Mental Disease for conservatees. The facilities are licensed by the Community Care Licensing Division of the California Department of Social Services. The Center specializes in serving people with difficult behavioral problems, monitoring psychotropic medications, and providing a safe and supportive environment to help residents achieve their highest level of independent functioning. 
 
The Agreement was executed by the County Administrative Officer under a special designated signing authority, pursuant to Minute Order No. 15-31, Item No. 9, approved by the Yolo County Board of Supervisors (BOS) on March 10, 2015. The first time this Board reviewed and approved an amendment to this Agreement was the during the review and approval of the second amendment. At that time, the second amendment was assigned BOS Agreement No. 19-242.
 
On or about On April 23, 2021, the County exercised the available option to extend the Agreement through June 30, 2022 adding $800,000. On or about August 31, 2021 the agreement was amended to add an additional $475,000 that was needed to cover the additional costs of buying four contracted beds.
 
Staff recommends approval of this amendment to add an additional $122,000 for Fiscal Year 2021-22, which will allow Willow Glen Care Center to cover remaining year end invoices.
 
Performance Measures:
Performance measures were included in the Fourth Amendment and are not being changed by this amendment.

County Counsel has approved this Agreement as to form.

Competitive Bid Process/Vendor Performance

In 2017, when the Agreement was initially entered, there was an “any willing provider” exception to the then current Yolo County Procurement Policy granted by the BOS, providing Yolo County Health and Human Services Agency (formerly known as the Department of Alcohol, Drug, and Mental Health) the ability to contract with any willing 24/7 residential care provider.  Under that exception, Willow Glen Care Center was classified as “any willing provider” and thus was exempt from the competitive bid process.
 
The Department confirms Willow Glen Care Center has performed satisfactorily on the current agreement.

No general funds are required by this action. These services will be funded by Realignment. The action increases the contract maximum by $122,000 for a total of $4,388,111 for the period of July 1, 2017 through June 30, 2022. The amount of $122,000 is included in the HHSA adopted budget for FY 2021-22.
