Subject

Adopt Authorized Position and Salary Resolution to implement changes in Assessor/Clerk-Recorder/Elections, County Administrator's Office, District Attorney's Office and Public Defender; approve an accelerated merit step increase for a Child Welfare Services Manager in the Health and Human Services Agency; appoint new County Librarian; and adopt a Certification Resolution excepting the 180-day waiting period when hiring retirees. (No general fund impact) (Lara)

Recommended Action

  1. Adopt Authorized Position and Salary Resolution to implement changes in Assessor/Clerk-Recorder/Elections, County Administrator's Office, District Attorney's Office and Public Defender;
     
  2. Approve an accelerated merit step increase for a Child Welfare Services Manager in the Health and Human Services Agency from Step 1 to Step 3 for exceptional qualifications and pay equity, effective January 15, 2023;
     
  3. Appoint Diana Lopez as the new County Librarian effective January 29, 2023; and
     
  4. Adopt a Certification Resolution excepting the 180-day waiting period to hire retiree Sheryl Hardy-Salgado.

Explanation: This action reallocates one (1) regular vacant full-time position from Senior Assessment Technician to Auditor-Appraiser II. While this action increases the potential cost of the position if hired at the highest level, the department has indicated they intend to underfill at an Auditor-Appraiser I, which will result in a cost savings in the current fiscal year.

Explanation: This action reallocates one (1) regular full-time position from Deputy District Attorney IV to Deputy District Attorney V. This action was inadvertently left off at recommended budget. A departmental promotional recruitment was conducted to fill the position at this level. The annual fiscal impact is $46,726 and will be funded by the Consumer Fraud & Environmental Protection Fund. This reallocation was already included in the 2022-23 Adopted Budget.

Reason for Recommended Action/Background

See Attachment A for changes to the Authorized Position and Salary Resolution.

Human Resources recommends the Board approve the request from Health & Human Services Agency to grant an accelerated merit step increase to Step 3 for Christina Maciel, Child Welfare Services Manager, for exceptional qualifications and to ensure pay equity, effective January 15, 2022. The Board of Supervisors may adjust the salary of an incumbent to any step within the salary range in order to correct inequities, reward outstanding achievement and performance, or for other reasons acceptable to the Board. Ms. Maciel is highly qualified, with extensive child welfare experience and has worked in Emergency Response, Intake/Hotline, and Court Investigations as a social worker and has worked in both Ongoing and training as a supervisor. Additionally, the accelerated merit step increase is being recommended to avoid any negative financial impacts on the incumbent, as Ms. Maciel is promoting from the class of Social Worker Supervisor II, where supervisors routinely work overtime to support the workload, participate in the stand-by and call back process, and respond to emergencies. This action will result in a 10.2% increase for the incumbent.

It is further recommended that that Board formally appoint Diana Lopez to the position of County Librarian effective January 29, 2023.  Ms. Lopez served as the Deputy Director of Community Services - Library in the City of Richmond since August of 2022.  She has nearly 18 years of library experience in other positions at the Marin County Free Library system as well as at Pasadena City College.  She holds a Master's degree in Library and Information Science from San Jose State University, and a Bachelor’s Degree in English from California State Polytechnic University, Pomona.

The Public Employees' Pension Reform Act of 2013 (PEPRA) and Government Code 7522.56 & 21224 requires that individuals who retire from a CalPERS agency wait 180 days before being reemployed by the same or another CalPERS Agency unless the individual chooses to reinstate from retirement. Government Code 7522.56 allows exceptions to this 180-day waiting period under certain circumstances including rehiring retirees in an extra help status to perform work of limited term duration and limited term special project work. Staff recommends approval of the attached CalPERS Resolution to allow the hire of one retired annuitant, Sheryl Hardy-Salgado, for the Department of Financial Services, to provide the fulfillment of a critical need to assist in the employment of a Property Tax staff, to train and develop staff, and complete necessary and time-sensitive property tax functions.
