Recommended Action

  1. Grant preliminary approval of Engineer's Report; 
     
  2. Adopt resolution declaring intent to continue levying assessment for fiscal year 2023-24; and 
     
  3. Order a public hearing for June 6, 2023, to consider the continuance of levying assessments for the Clarksburg Lighting Assessment District for fiscal year 2023-24.

Reason for Recommended Action/Background

The Clarksburg Lighting Assessment District was established in August 1982 under the Landscape and Lighting Act of 1972, with the adoption of Resolution 82-108.  The Assessment District is responsible for providing street lighting for the community of Clarksburg.    

In 2021, after gaining property owner ballot support, the benefit assessment was increased from $22 to $35 per parcel to continue providing lighting services to Clarksburg.

  • Ballot results: 71.8% of the property owners cast ballots in support of the proposed assessment
  • Board Approval of 1st year Assessment Levies: August 10, 1982
  • Fiscal Year 2022-2023 Approved Rate: $35 per parcel
  • Annual CPI Adjustment: In each subsequent year, the maximum assessment rate increases by the annual change in the Consumer Price Index (CPI-W and CPI-U) for the San Francisco-Oakland-San Jose, CA area for the most recent February to February as compiled by the Bureau of Labor statistics or five percent (5%), whichever is lower. The rate shall be rounded to the nearest dollar.
The change in the CPI from February 2022 to February 2023 is 5.3%.  Therefore, the maximum authorized assessment rates for Fiscal Year 2023-24 have been increased by 5.00%, rounded to the nearest whole dollar, resulting in a maximum authorized assessment rate of $37.00 per parcel (an increase of $2.00 from last fiscal year). The proposed assessment rate for the 2023-2024 fiscal year is $37.00 based upon the Engineer's Report and the cost projections therein.  A summary of the previous years' assessment rates and the proposed 2023-2024 rate is provided in the table below:

The Engineer's Report has been prepared by Yolo County Public Works, registered, professional engineers and submitted to the Board, in which an assessment is proposed to fund the cost of the maintenance and operations of the Clarksburg streetlights within the Assessment District boundaries. The engineer's report is attached as Attachment A. The projected costs for the continued operation and maintenance of the streetlight improvements is currently estimated at $6,436.00 for fiscal year 2023-24.

Adopting the Resolution of Intention (Attachment B) would preliminarily approve the Engineer's Report, provide notice of the Board's intention to continue levying the assessment with the inflationary adjustment, and provide notice for the required Public Hearing on June 6, 2023, at which time the Board will consider whether to approve the proposed $37.00 assessment on the properties identified in the Engineer's Report for fiscal year 2023-24, which will be collected on the tax roll.
