Reason for Recommended Action/Background
In August 2018, Valley Clean Energy (VCE), in conjunction with the Cities of Davis and Woodland and the County of Yolo, submitted a grant application and was granted funds, for the “Electrify Yolo” Project through SACOG under the Green Region Program in the amount of $2,911,752, with a local match of $377,248, or 11.47%. The grant has three main goals:
- Concentrated investment in electrification of the region’s transportation fleet to demonstrate technologies and our region’s interest in a zero-emission transportation future;
- Showcase the region’s ability to coalesce around clean transportation technology and signal to the State of California that we know how to effectively invest in clean transportation, and we should receive additional funds to further this goal; and
- Work with other programs around land use, transportation demand management, smart cities and infrastructure, and equitable access for all in a cohesive and comprehensive way that helps our region achieve its air quality and greenhouse gas emission goals.
The Electrify Yolo Project scope includes professional services to site, design, permit, construct, and install between 15 to 40 Level 2 Chargers and two to five DC Fast Chargers in downtown areas within ½ to 5 miles of major freeway corridors in Yolo County, Davis, and Woodland locations. The Electrify Yolo Project will also fund the purchase of 2 to 10 Mobile Chargers of a type similar to “EV ARC” solar standalone charging stations. The SACOG Board of Directors authorized the award for the Project in December 2018 for the full amount.
Fund Swap Agreement
Since the Project was approved in December 2018, staff from each of the jurisdictions and VCE have worked to develop a scope of work for a contractor to complete by the end of the grant period. As part of these efforts, SACOG recommended that the City of Davis perform a “fund swap” with SACOG. This would include the following: $2,912,000 in Congestion Mitigation and Air Quality funds from the Electrify Yolo Project Green Region grant award to replace an equal $2,912,000 in local funds into the Richards/I-80 Project. The City of Davis and SACOG agree that this exchange will have no net impact for funding implementation for either project. In other words, this is a “dollar for dollar” swap.
County-City of Davis MOU
In light of this swap of funds, the County developed a Memorandum Of Understanding (MOU) with the City of Davis to provide the funding for the Electrify Yolo Project so that County staff could advance the process and release a Request for Proposals (RFP) in Spring 2020, as well as complete the implementation of any charging stations by December 31, 2023. The County has identified potential locations for the charging stations and will update the Board as progress continues toward completion. It is required that all charging stations funded through this grant program, regardless of jurisdiction, shall be networked and publicly accessible through the internet, meet Americans with Disabilities Act (ADA) requirements, and utilize the same charging technology and infrastructure as all other charging stations.

The Department of General Services has identified the Davis Library as one of the locations to install an EV Charging Station. The Department was able to contract with Core Electrical and an agreement was executed on January 13, 2023. The initial agreement, PO4172, was for a total contract price of $58,192.00. However, during the assessment of the permitted plans and visiting the site following a change in the location of the EV chargier, the Contractor (Core Electrical Services, Inc.) discovered that the parking lot slope of the new EV charging station location and proposed crosswalk path to the library was not ADA compliant. The Department is requesting a change order to the original contract for an additional $10,305.15 to complete the additional work necessary to comply with the ADA, resulting in a new total contract price of $68,497.15.
The additional cost for the construction work described above exceeds the statutory contract change order limits for Public Contract Code section 20137. Changes exceeding the Public Contract Code section 20137 limit would ordinarily require competitive bidding. However, under Graydon v. Pasadena Redevelopment Agency (1980) 104 Cal.App.3d 631, competitive bidding is not required where the Board finds that such bidding would be unavailing and impractical and would not produce any public advantage. For the following reason, competitive bidding for the extra ADA work in this case would not have produced any public advantage, and it is in the County and the public’s best interest to work with the existing Contractor on the project rather than competitively bidding the limited project changes.

- Each of the items of the contract change order work is functionally integrated with the overall Project.
- The Contractor is already mobilized and onsite doing the Project construction and able to complete the additional work at the same unit prices in its competitive bid.
- It wouldn’t be practical to have a different contractor perform the change order work items because they are integrated with the overall infrastructure being installed and trying to advertise and competitively bid the remaining items for the Project at this juncture would only further delay completion of the Project at additional expense.
