Adopt a Notice of Exemption finding that the 2023 Road Rehabilitation Project is exempt from the California Environmental Quality Act (CEQA) and authorize filing of a Notice of Exemption pursuant to Public Resources Code 21152(b); adopt the plans and specifications for the 2023 Road Rehabilitation Project and approve the Project; Authorize the Director, Public Works Division to sign the Notice to Bidders; Authorize the Department of Community Services to advertise for competitive bids; authorize the Director, Public Works Division, to execute a construction contract with the lowest responsive bidder provided the contract amount does not exceed available funds, or to reject all bids; and authorize the Director, Public Works Division, to approve all construction change orders, provided the contract amount does not exceed available funds for the Project. Reason for Recommended Action/Background
These actions will allow the Department to solicit competitive bids and promptly proceed with construction of the 2023 Road Rehabilitation Project.
Background
The proposed County Roads (CR) where pavements will be improved in this project are located throughout the County as shown on the location map (see Attachment A) and listed below:

The proposed County Roads (CR) where pavements will be improved in this project are located throughout the County as shown on the location map (see Attachment A) and listed below:
- All roads in Esparto east of State Route 16 (Yolo Ave) includes Woodland Ave, Capay St, North and South Grafton Streets, Grafton St, Madison St, Plainfield St, Bonynge St, Winters St, Mattie St, and Alpha St
- CR 23 from CR 85B to CR 89
- CR 24 from CR 90 to CR 98
- CR 96 from Russell Blvd (CR 32) to 2357 feet north of CR 29
On road segments where the pavement life can be extended, the treatment will include digging out and replacing failed areas and then applying a triple layer seal, consisting of a micro-surface layer, followed by an asphalt rubber chip seal layer, and a slurry seal on top as the final layer.
In Esparto where the pavement has far exceeded its design life, the roads will be rehabilitated by milling and repaving the top three to four inches of the existing asphalt surface. This work will be followed by shoulder work to conform to existing grades and alleyways.
This project is expected to take approximately 70 working days to complete. The contractor will be required to always provide access to residences and businesses. Advanced notification signs will be placed to advise motorists to use alternate routes during construction. All roadwork will be done under traffic control that will involve lane closures and minor delays to traffic during the workday.
County Planning staff reviewed the project under the California Environmental Quality Act (CEQA) and determined that it is categorically exempt pursuant to CEQA Guidelines Section 15301(c) (existing highways, streets, and similar facilities). A proposed notice of Categorical Exemption is attached as Attachment B.

An encroachment permit is required to be secured by the contractor from Caltrans.
Competitive Bid Process/Vendor Performance
The competitive bid process will be completed in accordance with State law. Bids will be opened and read publicly at the Department of Community Services. A contract may only be awarded to the lowest responsive and responsible bidder.

Further explanation as needed:
Sufficient funds have been budgeted in the FY22/23 Road Fund Adopted Budget and the FY23-24 Road Fund proposed Recommended Budget for the 2023 Road Rehabilitation Project. Senate Bill 1 (SB 1), the Road Improvement and Accountability Act of 2017, will provide most of the funds for construction.
