Recommended Action

  1. Approve agreement with the California Department of Transportation regarding a state funding appropriation for the Capay Valley Health & Community Center; and
     
  2. Adopt budget resolution amending the 2023-2024 budget to Include a State Budget Act of 2022 Appropriation of $6,500,000.

Reason for Recommended Action/Background

The State Budget Act of 2022 included a $6.5 million appropriation to Yolo County for the Capay Valley Health and Community Center (Project), undertaken by the Yocha Dehe Wintun Nation. Upon receiving the appropriated funds, the County will pass the entire $6.5 million through to the Tribe for costs associated with the Project. Similar to the California State Parks funding agreement approved by the Board of Supervisors on July 11, 2023 (Consent Agenda Item No. 22), Caltrans requires the County to sign the attached agreement as a condition of receiving the appropriated funds. Changes to the Caltrans template agreement are shown in blue in the attached version of the agreement (Attachment A). The agreement is undergoing final processing by Caltrans and is expected to be ready for signature in the near future. A budget resolution that also includes language authorizing the Chair to sign the Agreement is included as Attachment B.

The Office of the County Counsel is working to complete an intergovernmental agreement with the Tribe concerning the appropriated funds. That agreement will ensure the funds are used and accounted for in the manner required by the Caltrans agreement that is the subject of this Board item. The intergovernmental agreement is anticipated to be presented for Board consideration on August 29, 2023. While the state funding will not be provided to the Tribe until the intergovernmental agreement is signed, approval of the Caltrans/County agreement is desired now to ensure there are no delays in receiving the state funding.
