Recommended Action

Approve and authorize the Chair to execute the second amendment to Agreement No. PO 4292 with Progress Ranch Treatment Center to add funding in the amount of $24,000 for fiscal year 2022-23, for a new contract maximum of $254,000, for the period of effective date through June 30, 2023, for the provision of providing short term residential therapeutic program services.

Reason for Recommended Action/Background

Progress Ranch Treatment Center is a certified outpatient behavioral health program that provides a full range of Title 9 outpatient diagnostic and treatment services for male children and youth ages 6-14 who are Seriously Emotionally Disturbed (SED), hereafter known as youth, and who are full-scope Medi-Cal beneficiaries residing in Progress Ranch Short-Term Residential Therapeutic Program (STRTP). These requirements in no way supersede the provisions of State Department of Social Services Community Care Licensing (CCL) Standards and eligibility criteria that apply to those children in the residential program. Progress Ranch Treatment Center complies with AB 403/Continuum of Care Reform requirements, the most current Department of Health Care Services (DHCS) STRTP Interim Mental Health Program Approval protocol/Interim STRTP Regulations, Katie A requirements, and the implementation plan consistent with these requirements, as determined by County of Yolo Children’s Behavioral Health Services, Child, Youth, and Family (CYF) Branch. Services adhere to Children’s System of Care (CSOC) principles. Services provided are required to be client and family driven and culturally and linguistically competent.

On or about May 27, 2022, the County entered into an Agreement with Progress Ranch Treatment Center to provide STRTP services. The initial term was from the effective date of the Agreement through June 30, 2023, with a contract maximum of $80,000.

On October 25, 2022, the Parties amended the Agreement via the First Amendment to add funding in the amount of $150,000 for Fiscal Year (FY) 2022-23 for a new contract maximum of $230,000, and to update and clarify language in the Agreement.

Approval of this second amendment is adding additional funding in the amount of $24,000 for FY 2022-23, which will allow for payment to be made for year-end FY 2022-23 claims processing. Delegated authority to the Chair has been requested to expedite the processing of the second amendment, so FY 2022-23 claims can be issued as soon as possible. A preliminary draft of the second amendment is attached hereto as Att. A. The final second amendment will be reviewed and approved as to form by County Counsel prior to execution.

Performance Measures included in this Agreement are as follows:

HHSA confirms Progress Ranch has performed satisfactorily under this Agreement. Progress Ranch has been a local provider of Specialty Mental Health Services (SMHS) to residents in their short-term residential therapeutic program. Their services are required, and essential, to the provision of needed mental health services to Yolo County youth, and youth placed in this Yolo County facility. HHSA and Progress Ranch meet monthly to evaluate their service to youth and ensure performance measures are adequately met. HHSA is satisfied with the performance and is maintaining an ongoing contractual relationship with Progress Ranch in the upcoming fiscal year.

County Counsel will approve the Amendment as to form.

Competitive Bid Process/Vendor Performance

On May 18, 2022, the then acting Yolo County Procurement Manager or designee approved a sole/single source procurement for these services.

Procurement reviewed HHSA’s request and determined that it was in the best interest of the County, based on satisfactory performance. Without sole source approval of the agreement with the vendor, the County would lose the ability to place youth in STRTP facilities. Factors considered, included but were not limited to:

1) the County’s ongoing difficulty with finding placement for serious mental illness and serious persistent mental illness clients; 2) no other STRTP providers in the surrounding area; 3) the price is fair and reasonable; and 4) County would lose the ability to place youth in a STRTP that has an available placement. The County would be limited in its ability to identify and place youth in a STRTP offering appropriate specialty mental health services that meet the needs of youth.

No general funds are required by this action. These services will be funded by realignment funding. The action increases the contract maximum by $24,000 for fiscal year (FY) 22-23 for a total of $254,000 for the period of effective date through June 30, 2023. The amount of $24,000 is included in the HHSA adopted budget for FY22-23.
