Reason for Recommended Action/Background

In 2018, the Board of Supervisors proposed measure imposing a gross receipts tax on commercial cannabis cultivation and related activities in the unincorporated area of Yolo County. On June 5, 2018, the tax was approved by a majority of voters voting on the measure. The tax measure is codified in Chapter 18 of Title 3 of the Yolo County Code and referred to therein as the “Cannabis Business Tax."

The measure establishing the Cannabis Business Tax required the Board of Supervisors to establish and appoint a citizens' oversight committee, with functions described more fully in Yolo County Code section 3-18.28. The Board of Supervisors established the Cannabis Business Tax Citizens Oversight Committee by adopting Resolution No. 18-94 on July 24, 2018, a copy of which is included as Attachment B.

As set forth in Resolution No. 18-94, each member of the Committee "shall serve a term of two years, with no term limits." This approach is inconsistent with the
County’s adopted policy on advisory boards, commissions, committees and councils, which provides that “[u]nless the Board specifically determines otherwise for good cause, in its sole discretion, no member may serve more than two (2) consecutive terms on an advisory committee without at least a one (1) year break in service before becoming eligible for reappointment to that same committee."

The attached Resolution would, if adopted, apply the term limit rule established by County policy to the Cannabis Business Tax Citizens Oversight Committee. The Resolution is not retroactive, and thus will not apply to "unseat" any existing Committee members serving a third term.

Supervisors Provenza and Barajas requested this Resolution to allow the Board to consider aligning the term limits for Committee members with the County's adopted policy.
