Appoint the Trustee Area 5 Governing Board Member to the Davis Joint Unified School District Board and the Community Services Districts members to their boards of directors in-lieu of conducting an election in the November 7, 2023, Special District Election, and appoint the Water District members to their boards of directors in-lieu of conducting their own election in the November 14, 2023, Landowner District Election. Recommended Action
- Approve and file the attached Certificate of Facts, indicating the number of persons who filed a declaration of candidacy for the Davis Joint Unified School District, Trustee Area 5 did not exceed the number of offices to be filled at the election for governing board member to fill the remainder of the term of the vacant office;
- Approve and file the attached Certificates of Facts, indicating the number of persons who filed a declaration of candidacy for the Cacheville Community Services District, the Esparto Community Services District, and the Madison Community Services District did not exceed the number of offices to be filled at the election for directors for the full term of four years;
- Approve and file the attached Certificate of Facts, indicating the number of persons who filed a declaration of candidacy for the Cacheville Community Services District and the Knights Landing Community Services District did not exceed the number of offices to be filled at the election for directors to fill the remainder of the term for the short term of two years;
- Approve the attached letters from the landowner districts who held their own election, indicating the number of persons who filed a declaration of candidacy for the Dunnigan Water District and the North Delta Water Agency did not exceed the number of offices to be filled at the election for directors for the full term of four years.

Reason for Recommended Action/Background
California Elections Code Section 15372 requires the county elections official to prepare and submit certificates of facts to the County Governing Body (Board of Supervisors) within 30 days of the election. The Assessor/County Clerk-Recorder/Registrar of Voters prepared the Certificate of Facts for the November 7, 2023, Special District Election to appoint candidates in-lieu of election. The Dunnigan Water District and the North Delta Water Agency who held their own election prepared a letter requesting the Board of Supervisors to appoint their candidates in-lieu of election. These recommended actions complete the procedure for an appointment in-lieu of election due to insufficient nominees for the November 7, 2023, Special District Election and the district held November 14, 2023, Landowner District Election.
