AGENDA ITEM TITLE:
Hold a public hearing and make a determination on the variance request to 90-16-07(G)(3)(a) Commercial and Industrial District Sign Regulations to allow for a digital billboard sign to replace an existing wooden billboard in a C-1 Local commercial zoning district located at 1146 South Main Street, or take other necessary action. LEGAL DESCRIPTION:
Lots 5 and 6 all in Block 68 in the City of Muskogee, according to the official plat thereof, Muskogee County, State of Oklahoma.
BACKGROUND:
Dyke Properties LLC has applied for a variance to 90-16-07(G)(3)(a) Commercial and Industrial District Sign Regulations to allow for a digital billboard sign to replace an existing wooden billboard in a C-1 Local commercial zoning district. The City of Muskogee Code of Ordinances states: “Digital signs shall be allowed only in C-2, C-3, I-1, I-2, and P Districts, or lots that abut the Highway Commercial District.” However, under section 90-16-07(G)(3)(b), a digital sign may be allowed with approval from the Board of Adjustment.
Through the strict application of the zoning ordinance, there is not an unnecessary hardship because subsection b gives a remedy to subsection a. With this at play, the variance becomes a request to allow the sign to exist under 90-16-07(G)(3)(b) with approval by the Board of Adjustment, allowing Dyke Properties LLC to continue with the installation of their sign
RECOMMENDED STAFF ACTION:
The variance request meets the conditions for approval.
